Children are attracted to water so know where your children are at all times. Even with a compliant barrier we see families leaving furniture within their reach that they can use to climb barriers, or allowing their kids into the pool enclosure but being distracted from active supervision.

Are you a Landlord of a property with a Swimming Pool. The Office of Local Government is allowing landlords to postpone compliance until the next lease is entered into, however we want to stress that does not mean that your Public Liability Insurer will accept this, in the case of an accident or worse. We contacted our Insurance Broker today and they confirmed that household insurance policies generally exclude damages arising from non-compliant swimming pools or spas with respect to minimum safety measures.
We recommend that all of our clients with a property in NSW with a swimming pool or spa, firstly register their pool if they have not already done so, and then organise an inspection with an Accredited Certifier so that your pool is confirmed as Compliant.  Landlords should be especially careful to protect themselves.

The Minister for Local Government today announced a new provision that will affect prospective buyers of properties with a Swimming Pool and/or Spa. The Vendor will now be able to pass responsibility onto the purchaser to rectify any non-compliances with their pool barrier so long as they have had their pool inspected by a Certified Officer like ourselves. Vendors are now allowed to effectively pass the cost & inconvenience onto the purchaser who will have 90 days to effect repairs. If you are about to purchase a property with a pool, contact us for clarification of how this announcement affects you.

Many pool owners are not aware that if a drowning (or near drowning which can lead to serious brain injury) were to happen in your uncompliant swimming pool, then your property insurer may have grounds not to insure your against any claim made against you, thus leaving you self-insured.
Check with your property insurer for confirmation, then call POOL CERTIFY to organise an inspection, so that you can have peace of mind that you are fully protected.

Property owners selling or leasing a property with a Swimming Pool will need a Compliance Certificate for their pool barrier by the deadline.
