UPDATE ON REFUSAL OF EHIC IN SPAIN
At a meeting of the EU Administrative Commission (responsible for the application of EEA rights on social security, including healthcare) in Brussels last week, Spain updated all member states present.

The Commission had visited their Ministry of Health on Monday 17th June and the following was agreed:
 Spanish hospitals that provide state healthcare will no longer be using the ‘consent' form, which has been used up until recently and included a clause which waived people's right to use their EHIC;
Spain will send guidance to their autonomous regions that their hospitals must accept the EHIC, and make genuine attempts to assist people to produce their EHIC, or give them adequate time to obtain a Provisional Replacement certificate (PRC) in lieu of the EHIC;

If an EHIC or PRC cannot be produced, Spanish hospitals must not charge insurers directly, but can seek monetary payment from the citizen on the state sector tariff only (customers can then seek reimbursement from the Overseas Healthcare Team on 0191 218 1999).

The Portuguese authorities have also responded to reports of similar incidences in their country by agreeing to approach providers in Portugal to advise them of obligations on accepting EHICs, and this course of action appears to have been successful.

The Department of Health and British Consular Network in Spain will continue to monitor the situation closely and will continue to collate examples of non-compliance, within the scope of the newly-agreed procedures, to take to the Ministry of Health and Commission when necessary. We ask that tour operators also notify us of any cases where customers have not been able to use their EHIC, or have not been given the opportunity to obtain a PRC.

If your members have customers who have difficulties using their EHIC or the hospital/health centre insists that travel insurance details are provided, they may call the Department of Health’s team in Spain on 902 109 356. Alternatively, customers may call the Overseas Healthcare Team in Newcastle on 0044 191 218 1999. To reiterate key points from our previous letter about EHIC use:  The European Health InsuranceCard entitles people to all medically-necessary treatment during their temporary stay in Spain - it is not just limited to emergency treatment;
 
In order for the EHIC to be accepted, they must attend a hospital or health centre that provides state healthcare. It is not accepted in a private hospital or clinic.

And most importantly: 
Policy holders are under no obligation to provide their travel insurance details in a state hospital or health centre. They have a right to insist that their EHIC is accepted for all necessary state-provided medical treatment. If they do not have their EHIC with them they can call the Overseas Healthcare Team in Newcastle, who will be able to provide them with a Provisional Replacement Certificate. PLEASE REMEMBER THAT EHIC IS NO SUBSTITUTE FOR TRAVEL INSURANCE AND WE WOULD RECOMMEND THAT YOU NEVER TRAVEL OVERSEAS WITHOUT ADEQUATE TRAVEL INSURANCE.
