Have you or a loved one been charged with an OUI 4th offense? You should understand that a fourth offense OUI charge differs greatly from a 1st, 2nd, or 3rd OUI. On the first court date, make sure you are prepared with bail money; you could be held for 120 days without bail as a danger to the community.

Massachusetts Supreme Court forced prosecutors to dismiss 21,000 drug convictions based on misconduct by the lab conducting the testing. In a separate case a judge found that that, “their misconduct evinces a depth of deceptiveness that constitutes a fraud upon the court.”

The field sobriety tests in #ridui #dui cases should generally be refused. It becomes routine for police officers to articulate a failure, even in cases where the motorist performs well on the physical agility portion of the test. In Rhode Island, there is no penalty for refusing the field sobriety tests.
