Anthony Douglas Williams captured the sentiment of many when he eloquently wrote, “When I look into the eyes of an animal, I do not see an animal. I see a living being. I see a friend. I feel a soul.” Many an animal lover would agree with his opinion but may be surprised to know, in the eyes of the law, animals are seen very differently. The majority of jurisdictions in the United States, including Arizona, classify pets as personal property, limiting damages for their injury or death to their fair market value. While this “property law” analysis makes it easy to determine damages in a typical negligence case (not much for the average family pet), it proves to be a difficult obstacle in resolving divorce disputes. It so happens that Alaska, one of the last states to join the union, is the first state to require courts to consider the well-being of a pet in divorce proceedings. The law not only requires judges to take into consideration the well-being of the animal, it also authorizes judges to award joint custody of pets. One small step for the health and welfare of Fido the family pet, one giant leap for human kind? Some say so. “The greatness of a nation and its moral progress can be judged by the way its animals are treated.” Mahatma Gandhi.
