What is a resort tort?

The term resort tort indicates that an injury occurred while on the premises of a resort, other recreational venue, or during a recreational activity. The injuries referred to in resort torts are injuries that are caused by the negligent or intentionally harmful actions of another individual or corporation, thus resort torts can be filed under civil liability laws. Resort torts can involve a variety of types of injuries, as well as a wide range of locations.

The common theme of all resort torts is that they involve tourists, business travelers, or locals who are involved in vacationing or other recreational activities. As a popular year-round tourist destination, South Florida has many more resort torts annually than other major cities. Tourists are often owed a higher duty of disclosure and care because of their lack of familiarity with their surroundings and the inherent risks associated with their location. The number of people killed in distraction-affected crashes decreased slightly from 3,360 in 2011 to 3,328 in 2012. An estimated 421,000 people were injured in motor vehicle crashes involving a distracted driver, this was a nine percent increase from the estimated 387,000 people injured in 2011.

10% of drivers of all ages under the age of 20 involved in fatal crashes were reported as distracted at the time of the crash. This age group has the largest proportion of drivers who were distracted.

*Florida had more than 80,000 #hitandrun crashes last year. *  According to the Florida Highway Patrol, fatal hit and runs increased by almost a quarter in Florida between 2013 and 2014 and about half of the victims were pedestrians.   The #AaronCohenLifeProtectionAct which was enacted last year following the hit and run death of #cyclist Aaron Cohen on #KeyBiscayne,  makes leaving the scene of an accident punishable by 3-year license suspension and a mandatory 4-year sentence for leaving the scene of a fatal accident.

Alcohol and cell phone use seem to have been the compounding reasons to explain why Alvarez killed an innocent person and seriously injured another.

This was reckless and irresponsible on every level.  The bikers/riders not only put their own lives at risk with their dangerous driving, but the lives of innocent people on the streets of Miami.  The most appalling thing is the number of videos that were posted on social by those who were clearly driving.  That includes people in their cars and those involved in the moto-mob.  #distracteddriving is deadly.
