BM's innovating, and this time it's to keep the number of employees it fires secret. 

By asking fired employees to dispute age discrimination claims only in private arbitration, the company is also getting around federal law that requires the disclosure of age and title data of workers in mass layoffs. My scoop: http://bloom.bg/SSVEvO
For at least a decade, International Business Machines Corp. gave fired employees information detailing a severance package that asked them to waive age- discrimination claims and also included a page listing the job titles and ages of workers being let go.

International Business Machines Corp. promised to keep 3,100 jobs in its home state through the next two years -- restoring positions the company eliminated last year.
