#BankruptcyLaw - What to Avoid Prior to a Bankruptcy Filing

Avoid Applying for High-Interest, Short-Term Relief Loans.Yes. One of the most common things that I see is people go try to procure advance check loans or payday loans. These loans have insanely high interest rates. They’re just impossible to pay off.

#BankruptcyLaw - You Can Expect Fair and Understanding Treatment in Court

I think in Utah, everybody is treated pretty well. The judges are very good. They’re very fair and very understanding. The trustees are not always the most cordial people, because they have a job to do, and that job is to make sure that your creditors are protected and to make sure that you’re not committing fraud.

#BankruptcyLaw - What Are the Fees Associated with a Bankruptcy Filing?

Chapter 7 Filing Requires Up Front Payment, Chapter 13 Is Structured on a Payment Plan. For a Chapter 7, you have to pay all the fees up front. That’s one of the disadvantages of a Chapter 7. With a Chapter 13, the lawyer actually gets paid through the payment plan.

#BankruptcyLaw - To Retain the Asset in a Bankruptcy Filing, You Have the Option to Reaffirm the Debt

A car works kind of the same way. If you have a car that you don’t want to keep, then you put it in the bankruptcy and surrender it, and the car company takes the car back and your debt is discharged. If you don’t want to do something like that, you have the option to reaffirm the debt.

The most well-known type of loan that can’t be eliminated in bankruptcy is student loans. There has been a lot of discussion about that in the national news recently. You can’t have student loans discharged.

#DUIDefense - How long will my license be Suspended?

When you get arrested for a DUI in Utah, you face two separate kinds of penalties. One type is the criminal penalties that you are probably already worried about. These consist of fines, probation, drug and alcohol abuse classes that a judge orders you to take, and jail time.

Most people in the public are aware of the high cost of getting a DUI. The cost of even a first-time DUI is used as a deterrent in anti drunk driving campaigns. And you may have seen advertisements for cab companies that say “A cab ride costs less than a DUI”. This is certainly true.

#DUIDefense - What Events Will Transpire After You Have Been Arrested for DUI?

When you’re arrested you may or may not be taken to jail. It does depend on the circumstances. The officer doesn’t have to technically book you into jail. Most of the time they do. But once you go to jail you will usually be released on your own recognizance without bail.

#DUIDefense - Do You Have to Be Inside of Your Car in Order to Be Charged with a DUI?

First of all, when it comes to DUIs, its part of the statute that you have to be in actual physical control of the car. So, if you’re outside of the car, then the officer can have a number of other problems establishing that you were actually driving the car.

#CriminalDefense - The Process Of Expungement For Assault Cases In The State Of Utah - Is there any way that someone can get it expunged or removed from their record?

Yeah. It is possible to get them expunged. In Utah, basically, there’s a waiting period. There’s a list of crimes that cannot be expunged.Assault, just regular assault is expungeable, so that’s good news. For a Class B misdemeanor you have to wait four years though.
