DMV Arrests Truck Driver for DUI While Operating a Commercial Motor Vehicle

DMV Inspector Arrest Truck Driver for DUI

Montpelier – Wednesday evening July 23, 2014 DMV’s Commercial Vehicle Enforcement Unit was conducting a directed patrol focused on checking for driver impairment due to alcohol, drugs and fatigue in Chittenden County.  At 10:27 P.M. a tractor trailer truck from Barnhart Transportation LLC., of Harborcreek, PA was stopped by Inspector Genevieve Paul because the driver failed to use his turn signal when he turned off from US Route 7 onto South Park Drive in the Town of Colchester. Inspector Paul approached the tractor trailer truck and detected a moderate odor of intoxicants emanating from the vehicle. This tractor trailer combination is registered to operate at a weight of 80,000 pounds on state and interstate highways.  

The driver, Michael Jones, age 50, of Springfield, MO admitted to consuming a 40 oz. beer approximately two hours prior to the stop. Jones produced a brown paper bag containing an empty 40 oz. Busch beer bottle and an empty Twisted Tea can.  Inspector Paul asked if there was any other alcohol in the vehicle and Jones produced a full Twisted Tea, a full 40 oz. Busch Beer, and a partially consumed 40 oz. Busch Beer from a cooler on the floor of the truck cab.

Inspector Paul, a certified Drug Recognition Expert (DRE), screened Jones for impairment and based upon her observations arrested him for DUI Alcohol. All Vermont DMV Commercial Vehicle Inspectors are certified to conduct Advanced Roadside Impaired Driving Enforcement (ARIDE) screenings.

As a result of this stop Jones was transported to the Colchester Police Department for processing. Jones was lodged at the Chittenden County Correctional Center for lack of $500 bail and arraigned in Chittenden Superior Court – Criminal Division today. 
At arraignment Judge Michael Kupersmith found probable cause that Jones was operating a commercial motor vehicles with a BAC of .04% or more.  Jones evidentiary breath test result was .077% at 11:30 PM on July 23, 2014. In addition he was placed out of service (unable to drive a commercial motor vehicle) for 24 consecutive hours for being in possession of and consuming alcohol. Jones was issued three Vermont Civil Violation Complaints totaling $1,038 for false log book/intoxicants in the truck, consuming intoxicants and failing to use a turn signal when required. The truck and trailer were towed from the scene of the traffic stop.
