A little humor to get us through this Wednesday!

Some clients have the last laugh in that they add a very specific clause to their will stating that if any of their beneficiaries so much as dispute the will, they are automatically cut off from receiving any inheritance.

What's scarier than your child leaving home for college? Not having any rights as a parent once they become adults!

For many high school #seniors and their #parents, reality is starting to set in that they will soon be leaving home to attend #college. One reality that should be setting in is that once your college student becomes an adult, you, as a parent no longer have authority to let's say, inquire and make decisions about their medical condition should they be hospitalized or become incapacitated. Preparing proper documents, such as a #HIPAA Authorization could avoid this surprise...especially in the face of a serious medical need.

Can YOU define "Estate Planning?"

Wikipedia's definition of estate planning - “the process of anticipating and arranging during a person’s life for the management and disposal of that individual’s estate during the individual’s life and at, and after, death while minimizing gift, estate, generation-skipping transfer and income tax.”

Confused yet? Yeah, we can see why! Most people still don't fully understand what "estate planning" really is...hence why 64 percent of #Americans don’t even have a #will.

According to Charlie Douglas' article, Estate Planning Needs an Extreme Makeover, "estate planning should support the family (or the individual) first, and thereafter concern itself with the transition of their assets" ... he believes estate planning defined, should include "protecting, preserving and enhancing the family through the accumulation, conservation and distribution of one’s assets and #values." - we couldn't agree more!

Estate Planning & U.S. Presidents

#Didyouknow the vast majority of #Presidents of the United States have left behind estate plans, or at least last wills and testaments. In fact, only four presidents have died without leaving behind a will, known as having died intestate.

Not surprisingly, two of the four include two of the presidents that were assassinated while in office: Abraham Lincoln and James A. Garfield. Lincoln’s successor, Andrew Johnson, also died intestate, as did his successor, Ulysses S Grant.

Many other presidents, such as George #Washington and John F. #Kennedy, left behind #wills that are available to read online.

How much debt does the average person leave behind?

#didyouknow 73% of consumers had outstanding #debt when they were reported as dead. Those consumers carried an average total balance of $61,554, including mortgage debt. Among the 73% of #consumers who had debt when they died, about 68% had credit card balances. The next most common kind of debt was mortgage debt (37%), followed by auto loans (25%), personal loans (12%) and student loans (6%).

These were the average unpaid balances: credit cards, $4,531; auto loans, $17,111; personal loans, $14,793; and student loans, $25,391. That’s a lot of debt, and it doesn’t just disappear when someone dies. It's so important to pay off your debts and protect what assets do you have!

Going back to Probate roots...

#didyouknow The term "Probate" comes from the Latin word Probare, meaning "to prove". Matters in early English religious courts were proven before an Ecclesiastical Judge. Early American Probate Courts are traced back to those English religious courts, which had jurisdiction over the probate of #wills and administration of estates. The first Probate Court in the United States was established in Massachusetts in 1784.
