The bank lacked a permissible purpose to access the consumer's protected credit information. I've represented clients whose ex's have used their employer's subscriber terminals to obtain my client's credit information. The employers squack when sued for impermissible access but they soon realize that they are exposed to substantial damages for their employee's illegal conduct. Consumer lawsuits are effective in reforming corporate conduct and also compensate the consumer for the invasion of their privacy.
