City of Denton Issues Statement on HB 40 and Upcoming Fracking Operations
Contrary to reports that have recently been disseminated publicly, the hydraulic fracturing ban has, in our opinion, been rendered unenforceable by the State of Texas in HB 40 such that we no longer have the authority to enforce the ban. The City of Denton, however, will continue to regulate other surface activities related to drilling operations per our existing oil and gas well drilling ordinance (an ordinance separate from the hydraulic fracturing ban ordinance), including the regulation of setbacks, fire safety, noise, traffic, hours of operation, etc., as allowed by HB 40. “The City recognizes the limitations to enforcing the fracking ban imposed by HB 40 and will comply with this new legislation,” stated George Campbell, City Manager.

This is of particular importance as Vantage Energy has notified the City that they will begin hydraulic fracturing operations on June 1. These operations have been identified as compliant with the existing city Code of Ordinances. Gas Well Inspectors will monitor the activities to ensure they remain compliant with municipal regulations, as allowed by HB 40.

The City has also been notified that, in response to the scheduled Vantage operations, there may be an organized protest at the drill site. Mr. Campbell said “we recognize and respect the right of citizens to peacefully assemble and will work diligently with any protest organizers to ensure the safety and protection of those gathering and of any gas well operations personnel. Throughout the past year or more, as gas well issues have been addressed in Denton, our citizens have demonstrated the utmost respect for the rule of law and we have no doubt that positive attitudes will continue to prevail.”

Due to inclement weather and hazardous road conditions, City of Denton facilities will delay opening until 10 a.m. on Thursday, March 5.

Update Friday, Feb. 27 1:45 p.m.: Due to the weather delay from Monday, the Thursday residential route was being collected today (Friday).  Because of deteriorating conditions today, collections have been suspended.  Most residents in the Thursday quadrant have had either trash or recycling collected.  The remaining carts will be collected tomorrow, Saturday, as weather permits.  We ask that residents leave the uncollected carts out and they will be emptied as soon as possible.  

Normal commercial dumpster collections are anticipated to begin Saturday as conditions allow.

The landfill at ECO-W.E.R.C.S. anticipates keeping regular operating hours today and Saturday.

Due to existing and projected inclement weather creating hazardous driving conditions, City offices and facilities will be closed Monday, Feb. 23. A final decision concerning trash pickup will be made in the morning based on road conditions whether or not the trucks can safely manage pickup, so for now go ahead and set your carts out.

I think some of you already anticipated closures. #preppers

We've heard through the grapevine that some folks are concerned about the new back-in parking on Hickory St. And we understand! It may seem a little intimidating at first. But we promise, once you've backed in once or twice, you'll be a pro.

It's like parallel parking. But much easier. 1) Identify the spot where you want to park. 2) Turn on your signal. 3) Pull forward and then back into the spot. By signaling, the driver behind you will know your intent and hopefully will be courteous and wait for you to park.
