To our Bell’s customers and the passionate craft beer community,
 
We want to clear up a few things regarding our federal trademark dispute with Innovation Brewing.
 
1. We have not, and are not asking them to change their name or their logo. There is no lawsuit. We are not suing them. We have not asked them for money. We have not asked them to stop selling their beer. We are asking them to withdraw their federal trademark application.

2. Our concern is with their United States trademark application and potential impact on our brand, which we have spent 30 years building.

3. I personally reached out to Innovation Brewing to try to settle this matter in February, 2014 and attempted to talk about this brewer to brewer instead of involving lawyers. Our efforts were rebuffed and Innovation Brewing choose to pursue this in the legal system.

4. Over the last year, we have offered co-existence agreements and have offered to pay for their legal fees. We tried to find solutions that would work for both of us. Their response was to ask for an exorbitant amount of money and we did not feel that was a collaborative solution.

5. All offers that we proposed were rejected and after more than a year of discussion regrettably, this matter has moved to the federal trademark office.

We have the utmost respect for Innovation Brewing and we are going to keep any comments we have regarding this matter positive, honest, and collaborative. We want them to continue to brew and do the good work they’re doing under their own name.
 
We hope to resolve this as swiftly as the system will allow.
 
The passion that we have seen over the past few days is a testament to how much the beer industry means to those who support it and why we are proud to be a part of it. +Bell's Brewery, Inc. Now that I am caught up, I say stay the course. The way I read this is, the big corporation didn't trademark something they could have, and now have prior use. And now some small company who didn't do their research before naming their company is trying to poke a sharp stick in Bell' eye.

Nice to see Bell's make it out here to the West Coast...saw several choice at Whole Foods here in Santa Barbara.  Picked up an Oberon for starters.  Two-Hearted, one of my favorites was there as well.

We hear and appreciate everyone’s comments about a trademark issue with Innovation Brewing.

We are doing our best to continue working through this as amicably as possible and are hopeful we can find a mutual resolution.

Out of respect for the legal part of this process that we are now in, we will decline commenting further.

I am in the middle of something similar with a trademark dispute.  Sadly the average person doesn't realize that if you don't protect your trademarks, you gave them away.  When you are a start up (as I was only 3 yrs ago), you need to be very careful not to infringe on others' trademarks. Sometimes it's purely accidental, while other times it is done consciously.   Bell's caught this one very early in the trademark process and nicely offered a TM registration buyout which would have allowed the other company to start over with fresh ideas.  And they didn't take it.

My dispute was even worse, the guy even squatted on a .net domain and is in the same industry, so by the time he's done with attorneys and court fees, he will lose his house. It was his choice as it was conscious, and we offered him a buyout early enough not to harm his business.  But he "copped an attitude" for some reason and now he's going to pay the steep price.

He was me in 2012, and I made the conscious decision NOT to infringe on others' trademarked concepts.

Best of luck in resolving this soon. We'll up our intake of Bell's to help the cause!

Introduction
Bell's Brewery, Inc. began in 1985 with a quest for better beer and a 15 gallon soup kettle. Since then, we've grown into a regional craft brewery that employs more than 200 people over an 18 state area, in addition to Puerto Rico and Washington DC.

That dedication to brewing flavorful, unfiltered quality craft beers that started in 1985 is still with us today. We currently brew over 20 beers for distribution as well as many other small batches that are served at our pub in Kalamazoo, Michigan, the Eccentric Cafe.

Our ongoing goal is to brew thoughtfully, creatively and artistically. We strive to bring an authentic and pleasant experience to all of our customers through our unique ales and beers.
