Atlanta DUI Lawyer for my Atlanta DUI
By: William C. Head, DUI Lawyer Atlanta

Atlanta DUI lawyers range in experience from novice to the best DUI lawyer in Atlanta. If low price or cheap DUI lawyers is your objective for a DUI Atlanta case, don't expect the top rated Atlanta DUI attorneys to be in your price range. Supply and demand controls here, just like in any professional specialty.

For those who MUST WIN, and will fight a DUI in Atlanta, the task is to compare credentials and lawyer ratings of Atlanta DUI Attorneys to find a good match for you. Many attorney ratings badges and claimed online recognition for DUI attorneys are bogus, and not taken from peer-reviewed surveys of Atlanta lawyers who anonymously voted on the best DUI lawyers in Atlanta. Only THREE legitimate legal credentials rating services have collected extensive lawyer ranking data from Atlanta attorneys, and only one ABA approved organization offers Board Certification.

Instead of being swayed by glitzy websites, claims of being an ex-prosecutor and displaying meaningless badges, read this shocking article that debunks such faux accolades:

William C. Head, Atlanta DUI lawyer, has handled felony and misdemeanor cases in Athens, GA for 40 years. The criminal justice attorney was originally sworn in as a member of the Georgia Bar on June 10, 1976, at the Athens, Clarke County Courthouse in Athens, Georgia. Mr. Head has handled hundreds of alcohol and drugs cases, both misdemeanor and felony, in the courts of Athens, GA. The first 14 years of his legal practice were based in Athens, GA home of the UGA Bulldogs.

The number of underage drinking, or possession of alcohol under 21 cases in Athens-Clarke County, GA exceed the total possession of alcohol by a minor charges in Fulton County, GA, or Cobb County GA, or Gwinnett County GA or DeKalb County GA) and all of these counties boast populations of about 1 million residents. The year-round Athens’ population is about 125,000 residents.

Since a 2015 legislative change, MIP (minor in possession) cases are now being made by citation, and arresting and jailing the UGA student or visitor to campus at the Athens Clarke County jail. This WSB-TV news story in 2012 about the over aggressive arrests being made in Athens was instrumental in getting Georgia laws changed. The Georgia Legislature modified Georgia law to take away the right of Athens Police to arrest, absent some other crime being detected (such as possession of a false ID, obstruction of an officer, etc.)

After the change, local police (in 2016) have added federal agents to the law enforcement presence in downtown Athens, searching for underage drinking and possession of alcohol under 21 cases.

Beating the alcohol breath test or blood test - GA breathalyzer - Intoxilyzer 9000 device used in Georgia - excluding a breath alcohol test under Georgia implied consent law -

Under Georgia DUI laws, police officers are taught to read the Georgia implied consent law notice, and get an answer whether the suspected drunk driver is willing to blow into an alcohol breathalyzer test, or take a blood alcohol test, or blood test for drugs. GA implied consent law is read after a DUI arrest, as a means of legally compelling submission to forensic testing. The Intoxilyzer 9000 is Georgia's only approved breath alcohol test, at this time, but officer in Georgia can ask for blood urine or other bodily substances.

Be aware that the Intoxilyzer 9000 --- the OFFICIAL test --- is NOT the roadside, portable breathalyzer. It is not a preliminary test, conducted on handheld breath alcohol analyzer. It is either on a desktop, counter top, or wired into a mobile BATmobile (Breath Alcohol Testing mobile van or truck.) In GA, these handheld devices (used by law enforcement at the roadside) are 100% optional, and declining to blow is perfectly acceptable, since they are not the "implied consent test" in Georgia.

A primary way for the best drunk driving lawyers to win a DUI in Georgia is through motions in limine and motions to suppress breath tests and blood tests obtained under implied consent laws. If your Georgia DUI lawyer is not up to speed on GA implied consent law, or lacks full breath test training, then viable DUI defenses to the alcohol breath test or blood test results may not be raised, argued and ruled upon.

Call our DUI specialists for a FREE professional case evaluation, if you are facing drunk driving charges in GA. This is especially true if you will challenge your results from the breathalyzer. Hire a DUI lawyer who knows how to beat a breathalyzer. Our DUI law firm can help: Call us at 1-888-DUI-HEAD [1-888-384-4323], DUI guru Bubba Head.
