Field sobriety test - DUI eye test - Vertical Gaze Nystagmus of VGN - this is the second part of the nystagmust test used by law enforcement officers, and always follows the horizontal gaze nystagmus test or HGN test. Neither of these is a TRUE sobriety test. Although based loosely on a medical proceure known as lateral gaze nystagmus, the HGN is NOT used in the medical world to judge alcohol impairment or liekly blood alcohol test levels. Beating the breath test - GA breathalyzer - Intoxilyzer 9000 device used in Georgia - breath alcohol test - Made my CMI of Owensboro, KY - alcohol breath test

Under Georgia DUI laws, police officers are taught to read the Georgia implied consent law notice, and get an answer whether the suspected drunk driver is willing to blow into an alcohol breathalyzer test. A similar process occurs in most cases after a DUI arrest (when alcohol is the suspected impairing substance). The Intoxilyzer 9000 is Georgia's only approved breath alcohol test, at this time.

Be aware that the Intoxilyzer 9000 --- the OFFICIAL test --- is NOT a portable breathalyzer. It is not a handheld breathalyzer. It is either on a desktop, counter top, or wired into a mobile BATmobile (Breath Alcohol Testing mobile van or truck. In GA, these handheld devices are 100% optional, and decling to blow is perfectly acceptable, since they are not the "implied consent test" in Georgia.

Should I take a field sobriety test? NO.
Police field sobriety tests like this HGN test and the VGN test are designed to FAIL and sobriety tests used by police are not scientific tests.

I have known Bill for about 15 years. Several years ago, I had a nasty felony DWI case in Asheville, and had hired a local criminal defense attorney in Buncombe County as co-counsel. He was useless, unfortunately, and he could not believe I was fighting a fourth offense DWI case, which occurred at a DUI checkpoint by a state patrol officer.
