Will comment later, but someone has been drinking the Kool-aide, no doubt.

Seems like a good defense to me.

B.S. is my answer .A fetus is life from the moment of conception. Our own laws say to murder  pregnant woman,  is to be liable for a double homicide. The video's that show Conception to first trimester, to second trimester, to third trimester, show the growth and development of the "baby" inside the uterus. There is neurological receptor activity as early as 45 days.  the Ultra sounds show the baby formed. and sucking it's thumb.Who ever came up with this statement is dramatically ill informed as to the development of the baby.

Hospital lawyers argued that the court “should not overturn the long-standing rule in Colorado that the term ‘person,’ as is used in the Wrongful Death Act, encompasses only individuals born alive. Colorado state courts define ‘person’ under the Act to include only those born alive. Therefore Plaintiffs cannot maintain wrongful death claims based on two unborn fetuses.”
This is a lawsuit, not a debate over how many angels can fit on the head of a pin. A trial lawyer is trying to shake down this hospital for a bundle of money on what strikes me as a pretty dodgy claim. The case is governed by statutory law not the emotions of the peanut gallery.
