In early April 2018, retail giant Target agreed to revisit its guidelines for how it screens candidates applying to work in its nationwide stores. The move came after numerous complaints claiming that Target discriminates against people of color with criminal records including offenses too old or too inconsequential to affect their performance as employees of the chain.

The NAPBS is at odds with the New York City Commission on Human Rights over the interpretation of the Fair Chance Act, a ban the box law enacted in New York in October of 2015. The Commission sees the law as requiring a two-step screening process, separating the criminal history element out of the rest of the screening process, but the NAPBS says that method would place unnecessary burdens on employers, CRAs, and applicants.

Even as the "ban the box" movement sweeps across the nation, collecting 25 states and more than 150 cities and municipalities to its name, Indiana Governor Eric Holcomb recently signed a law to "un"ban the box for all employers in the state, including those in Indianapolis and Marion County, where ban the box has been the law of the land.

Once again, rideshare company Uber is back in the public eye, along with its competitor, Lyft. As part of a recent deal made with the state of Massachusetts to allow the two companies to offer their services at Logan Airport, both Uber and Lyft agreed to let the state run its own employment background checks on drivers....and now more than 8,000 workers are without jobs.

The landscape of employment background screening is changing rapidly in the rideshare/taxi market because of services like Uber and Lyft. How important is it to you to know that your driver has a completely squeaky-clean record?
