#HIPAA Security Rule has been around since 1998 and deals with ePHI (Electronic Protected Health Information). A series of changes in cell phone capability, payment systems, routing equipment among other technologies requires that this rule be updated. Only marginal changes have occurred since 1998 with the latest being delegation of limited enforcement authority to Office of Civil Rights in 2009. OCR Cybersecurity Newsletter: Guidance on Disposing of Electronic Devices and Media

US Department of Health and Human Services, Office of Civil Rights (OCR) recently published a newsletter guidance on disposal of electronic devices and media.

In this newsletter, OCR warns about improper disposal of electronic devices and media that puts the #ePHI stored on them at risk and could lead to data breaches. This could cost the responsible organizations in terms of regulatory fines, breach notification expenses, lawsuits, consultant and legal fees, and loss of business.

Devices or media that need to be replaced should be decommissioned and disposed of securely to ensure that the media are destroyed or any confidential or sensitive information stored on such devices or media has been securely deleted. Decommissioning is the process of taking hardware or media out of service prior to the final disposition of such hardware or media, said OCR.
