Happy Holidays to all my peers in the Accounts Receivable Management (ARM) industry! With the tax season upon us, it is holiday season for businesses of every kind who will be marketing at the discretionary dollars consumers will be receiving from their 2015 tax refunds. ARM companies are no different as we make tax season settlement offers, however with the billions of dollars of dormant judgement inventory in the market today shifting to garnishments may prove to be a more successful tax season strategy.

Having data does not make it useful. From our experience, we have generated hundreds of reports and ad hoc database queries and rarely do these reports explain ‘Why’ something is happening.

We all know the definition of insanity. Say it with me…..doing the same thing over and over again and expecting a different result. If your letter stunk last year, I can smell it from here this year. If you didn’t get results from your mailing last year something has to change.

As a company servicing the debt collection industry it is vitally important to partner with the “right” clients. Minimizing risk, while maximizing profit has never been as important as it is right now.

In its conclusion to the new report, the CFPB comments that “[i]n contrast to the robust federal protections for borrowers with mortgages, there is currently no comprehensive statutory or regulatory framework that provides uniform standards for the servicing of all student loans.”  This comment strongly suggests that in addition to supervising nonbank larger participant servicers of federal and private student loans, the CFPB is considering rulemaking to establish servicing standards for student loans.

 “Security National Automotive Acceptance Company took advantage of military rules to put enormous pressures on servicemembers to pay their debts,” Cordray said in a written statement. “For all the security they provide us, servicemembers should not have their financial and career security threatened by false information from an auto loan company.”

The Servicemembers Civil Relief Act may seem like an unassuming law, but as those who do business with active military status servicemembers know, it has sharp teeth. Those who fail to produce an affidavit as to military service and wade through court red tape before pursuing debts, liens or foreclosure against someone protected under this law can face serious penalties in civil or even criminal court.

In March 2015, despite widespread industry criticism, the CFPB announced that it had decided to adopt its plans to publicly disclose the narratives.  According to a new CFPB blog post about the availability of the narratives, since the CFPB’s complaint form began advising consumers of their right to opt-in to disclosure of their narratives, approximately 59 percent of consumers submitting complaints through the CFPB’s website have opted-in.
