Did the Bus Driver in the Chester County Crash Get Charged?: In November of 2016, a Chester County school bus driver caused a bus accident that led to her bus rolling over. Nearly two dozen students suffered varying degrees of injury, with three injured critically. The bus driver has been incarcerated since the accident. She was recently indicted on 35 felony counts of aggravated assault with a deadly weapon and one count of felony reckless endangerment. An investigation into the accident found that the driver was driving too fast as she exited an interstate, where the posted speed limit is 40 miles per hour. The driver lost control, traveled off the ramp into gravel, engaged the brake and turned in the opposite direction. The forces caused the bus to strike a guardrail and flip over. Did the Penn State Fraternity Get Charged for Tim Piazza’s Death?: The death of Timothy Piazza in February left Penn State reeling and his family with many questions. During a fraternity initiation event for the school’s Beta Theta Pi chapter, pledges were made to drink large amounts of alcohol in a short period of time while completing a series of challenges. A short time into the night, Piazza showed signs of severe intoxication. He fell down a flight of stairs head first and suffered the first of a series of traumatic brain injuries that would eventually lead to his wrongful death. Despite his obvious injuries, the other men present did not call 911 for fear of consequences due to his intoxication. It took nearly 12 hours for the fraternity to call emergency services. Does My Insurance Cover Car Fires?: A Mt. Juliet family is still recovering from an incident two weeks ago that led to burn injuries for a Tennessee woman. The woman was driving five of her children for a day in Long Hunter State Park when the unthinkable happened. As she pulled into a parking spot, suddenly, all of the lights on her dashboard came to life before the van sputtered to a halt. Smoke began billowing from under the hood, and it was only when one of her young sons stepped out of the car to look at it from outside that he noticed the fire. Do You Have a Car Accident Injury When a Preexisting Condition is Worsened?: When a person is hit by a negligent driver, does he or she have a car accident injury case if the wreck exacerbated a preexisting injury? This issue was part of a recent case on appeal in Tennessee stemming from a rear end accident on I-24 that occurred in 2011. In Kempson v. Casey, No. E2015-02184-COA-R3-CV, (Tenn. Ct. App. Nov. 2, 2016), the Plaintiff alleged neck injuries and pain from the accident, which necessitated a three level cervical discectomy and fusion for cervical disk herniation and myelopathy in 2012. Defendant argued these injuries stemmed from an incident in 1998, when Plaintiff had preexisting complaints regarding his cervical, thoracic and lumbar spine. Further, Defendant pointed out that Plaintiff had been involved in a different car accident in 2006.
