House Tax bill may impact divorce proceedings

The House Republican tax bill is being revealed on Thursday. Below are some aspects of the tax bill which, from my view, assuming they are passed, present some challenges in divorce proceedings:

1. Mortgage deduction. This is a component of the formula used in California to determine child support and in some cases temporary spousal support. The bill preserves the mortgage deduction as currently structured for existing mortgages. But it curbs it for mortgages on newly purchased homes going forward. You would only be able to claim a deduction for interest you pay on mortgage debt up to $500,000, down from $1 million today.

2. Alimony deduction. The bill eliminates the alimony (spousal support) deduction. The ability to deduct spousal support for the payor of spousal support has made them easier to stomach for the paying spouse. Without the deduction, settlement of spousal support is going to be harder and the payor of support may be less willing to agree to pay alimony in divorce settlements. Moreover, if support cannot be deducted anymore, this would fundamentally affect the state wide use of the support calculators (X Spouse or DissoMaster). These two programs presume spousal support is taxable to the receiving spouse and deductible by the payor. This could mean that using the programs as they exist would not be appropriate if the tax bill passes.
