Trusts vs. Will - Special Needs Trust benefits. Transferring assets to a disabled individual can be tricky. Using a Will to transfer a home, for example, is great as long as the individual uses the home as their primary residence and can manage the property. Unfortunately, if they need to move or can no longer take care of the property, the home becomes an available resource and can put the individual over the asset limit for means-tested programs like Supplemental Security Income or Medicaid. Setting up a Special Needs Trust will protect the asset for your disabled inheritor, without loss of means -tested benefits.

Trusts vs. Last Will and Testament. Each have their place. By simply setting up a trust you can better protect your assets as well as avoid the probate process. By writing a Last Will and Testament, the Will is subject to the probate process and may be easily revoked.

A person who owns a business that is not incorporated is called a sole proprietor. All income for a sole proprietorship is taxed at the individual income tax rate and provides no protection from creditors.
