Child Relocation

Relocation (that is where one parent wants to change the location of where the children of a relationship or marriage are to live) is often considered one of the most technical and complex areas of family law. Bodekers Family Lawyers & Mediators can assist you in agreeing custody/care arrangements for a relocation or can guide you through the court process if necessary.

Sometimes when a marriage or relationship breaks down one of the parents wants to move or relocate overseas, interstate or even within the state to be with family or sometimes with a new partner.

That parent may want to take the child or the children of the marriage with them, naturally, they will need to obtain the consent of the other parent and/or the permission of the court.

Of course it is better if parents can agree to custody/parenting arrangements that are in the best interests of their child or children.

Property Settlement - Perth Family Law

Upon the breakdown of a marriage or de facto relationship couples usually need to finish their financial relationship. It may involve getting an order from the Family Court of Western Australia by consent so you do not have to appear in court but can have the peace of mind that the financial relationship is terminated so far as is practicable by an order of the family court.

Grandparents Rights - Perth Family Law

Annulment for Previous Marriage – Perth Family Lawyers

A marriage may be void if at the time, either party is legally married to another person.

In Song and Huang [2016] FamCA 78, the applicant was previously married overseas and mistakenly believed the divorce had been finalised. She then married the respondent in Australia, not realising she was still legally married.

Once the divorce was truly finalised, she applied for the new marriage to be annulled so she could legally remarry in Australia.

The court granted a decree of nullity, acknowledging that the applicant’s previous marriage was still valid at the time of the new one, making the new one void.

Annulment vs Divorce – Perth Divorce Lawyers

Divorce brings a marriage to a legal end, but a decree of nullity of marriage declares the entire marriage null and void, like it never existed.

Annulling a Void Marriage – Perth Family Lawyers

A decree of nullity of marriage can only be made when a marriage is void.

Under the Marriage Act 1961, a marriage may be void where:
• Either of the parties is, at the time of the marriage, lawfully married to some other person;
• The parties are within a prohibited relationship;
• The marriage is not a valid marriage
• The consent of either of the parties is not a real consent because:
o It was obtained by duress or fraud
o A party is mistaken as to the identity of the other party or as to the nature of the ceremony performed
o A party is mentally incapable of understanding the nature and effect of the marriage ceremony
• Either of the parties is not of marriageable age
