St. Louis Truck Accident Lawyer Discusses Their $1.3 Million Settlement (https://goo.gl/d5mL3A)

Our firm handled a trucking case that was one of the most technically complex we've ever seen and one of which we're very proud to have handled.

It started with simple facts.

Our client was on the highway when the truck driver in the right-hand lane moved into her lane and forced her off the road.

When we dug deeper, we realized there was much more.

What made this case unique and complicated:

☛ The truck driver was an immigrant who had come to the US, bought an 18-wheeler, and went into the trucking business despite not having any experience. He partnered with another immigrant who ran a "trucking company" that was basically a sham operation.

There was no safety department or safety regulations in place to ensure everything was operating safely.

☛ On the day of the crash, the truck driver wasn't hauling a load for the company, but rather driving across the country to repair the transmission.

☛ The driver maintained his own policy which only covered him when he was not driving on behalf of the company.

The defendant's argument
The company's lawyers and insurance company tried to claim that they were not responsible because the defendant driver was not operating on behalf of the company.

What we argued
They were liable based on DOT Liability and the fact that the company name was displayed on the side of the truck.

The outcome
The insurance companies tried to settle for $600,000 arguing that only one policy would apply. We knew we could do better. Through a series of legal maneuvers, we were able to get both policies to apply, and in the end, the companies agreed to pay $1.3 million total shortly before trial.

This is just another example of why it's important to work with attorneys who have an intimate knowledge of trucking law.

Why You Should Hire a St. Louis Car Accident Lawyer for Rear-End Collisions Claims (https://goo.gl/f2FQkS)

Did you know that rear-end collisions are almost as common as frontal crashes?

Generally speaking, these types of crashes occur while drivers are sitting in traffic, behind a stop light, or at a stop sign, and they're usually distracted.

Multiple cars can sometimes be lined up and cause a chain reaction, causing drivers to become "sandwiched" between cars.

Avoiding rear-end crashes
A police report will determine who was the at-fault driver. Usually, they're the ones who should have allotted more distance between their car and the car in front of them.

Even though you can't control what the driver behind you is doing, you can prevent the compounding of an accident by giving yourself space behind the car in front of you. That way, if impact should occur, you won't be sandwiched between two cars, which could potentially lead to more severe injuries.

So, do you need a personal injury attorney for a rear-end accident?
It depends. If it was a simple fender-bender without injuries, then probably not.

However, if a "sandwiching" incident occurs, the insurance company of the driver in front of you may try to get a recorded statement. In this case, we recommend speaking to an attorney about your rights before you say a word to them.

Do You Need a Personal Injury Attorney for a Frontal Impact Crash? (https://goo.gl/f2FQkS)

Front impact car crashes are the most dangerous type of accident. They result in head-on collisions that are responsible for the most injuries and fatalities compared to other types of accidents.

Most commonly, these types of frontal crashes involve other cars, trees, or road obstructions.

Avoiding a head-on collision
Speed and distraction are two factors that typically cause head-on crashes. If you see another car coming toward you, there's little time to waste. Pull over as far to the right as possible and slow down.

Sometimes the driver doesn't know they're heading in the wrong direction, so if they pass you, try flashing your lights at them.

Do you need an attorney?
Yes, especially if the accident involved a wrong-way driver.

Injuries from front-impact car accidents can be severe and medical bills enormous. You should be focused on healing and letting an experienced St. Louis car accident lawyer gather evidence and fight the insurance companies on your behalf

Allard was riding as a passenger in the pickup truck that Smith was driving when she crossed the center line, over-corrected herself, and went traveling off the right side of the road. Her truck struck a fence and the vehicle overturned onto its driver's side, which caused Allard to partially eject.

Should You Hire a Personal Injury Attorney for a Low-Speed Car Accident in Missouri? (https://goo.gl/f2FQkS)

Most accidents that occur in St. Louis are low-speed, which means they could happen while backing out of a driveway or driving slowly through a neighborhood.

Although your car isn't traveling at 75mph, it's still much heavier than your body, so even a fender-bender can result in whiplash that requires several doctors visits.

Avoiding Low-Speed Collisions
When driving at low speeds, always keep in mind that you are still driving, so don't let your guard down. Most accidents occur a few miles of your home or workplace.

To avoid an accident, never drive distracted or in a hurry.

Do you need an attorney for a low-speed crash?
Maybe! If the accident only entailed damages to your vehicle, you might be fine representing yourself. However, if there was any injury, you should consult a personal injury attorney as soon as possible.

If you or a loved one has been injured in any type of accident, please contact Schultz & Myers Law Firm to speak with a Missouri personal injury lawyer and learn how we can help you obtain the maximum compensation available.

St. Louis Truck Accident Lawyer Explains the Implications of Poor Visibility on Liability: Part 2 of 2 (https://goo.gl/Nfy4qx)

When Truckers Drive With Lights Off

Have you ever been on a relatively open road after dark and notice that a tractor-trailer's back lights aren't working?

It has to be one of the most frustrating and dangerous situations.

A crash involving a small car and the back of a semi-truck can be deadly. Although certain safety features like the Mansfield Bar can reduce your chances of dying in the truck accident, an under-ride crash can cause serious damage to a smaller vehicle.

Don't think that because you've rear-ended someone else, it's automatically your fault!

If poor visibility was a factor, you might have more options than you realize, especially if the driver neglected to do a full truck inspection before departing on the trip.

If poor visibility was a factor in your truck accident, don't let the insurance company play the blame-game. Contact an experienced personal injury trial lawyer at Schultz & Myers to get the compensation you deserve. Our consultations are always free at 314-444-4444.

You can also get in touch with a St. Louis injury attorney at our firm by sending us a confidential message through our website at (https://goo.gl/PH9PYs).

St. Louis Truck Accident Lawyer Explains the Implications of Poor Visibility on Liability: Part 1 of 2 (https://goo.gl/Nfy4qx)

A YouTube video posted by a local in Jefferson City, Missouri shows a dump truck blowing smoke through the street, preventing other drivers from seeing ahead of them. Fortunately, no one was injured.

What If You Rear-End A Vehicle You Couldn't See?
In this scenario, if an accident occurred, it would happen behind the dump truck, and because the truck driver would not likely know it was occurring, he wouldn't stop. It would be nearly impossible to track him down and get his truck company's insurance to cover any damages.

If the truck was hit, though, you'd have more of a case. A car accident attorney would then assess if the accident could have been prevented.

Proving negligence, in many cases, involves proving that the driver took the proper precautions to avoid an accident.

Have You Been Injured Using the Essure Birth Control System? (https://goo.gl/fxo1qh)

Essure is a birth control system used by more than half a million American women. It consists of two metal coils that doctors implant in each fallopian tube to cause the development of scar tissue that prevents fertilization.

Bayer Pharmaceuticals, which acquired the device's original manufacturer, Conceptus in 2013, claimed that the device was a non-invasive form of permanent birth control that was 100% effective with quick recovery time.

However, the FDA has received reports from over 5,000 women filing lawsuits against the manufacturer, claiming the device has perforated their organs, caused pelvic pain and permanent disease, and basically ruined their lives.

The victims claimed that Bayer had neglected to offer a proper warning about potential side effects.

If you have been injured after using the Essure Birth Control system, we encourage you to call our office at 314-444-4444. Consultations at Schultz & Myers are always 100% free and confidential. There is absolutely no obligation to sign on with our firm after having a consultation. That's one of the ways Schultz & Myers puts YOU first.
