Microsoft CEO - An Immigrant Workers American Dream

Nadella is one of many entrepreneurs and engineers who came to the United States via H-1B visas to work in the IT sector.  In the 2012 fiscal year, more than 135,000 people were issued H-1B visas, a type of visa that allows US employers to temporarily employ foreign workers in "specialty occupations" -- fields like engineering, biotech, education or law, according to the US Bureau of Consular Affairs. The heads of many of the world's largest tech companies have called for an increase of the cap in H-1B visas, as a way to attract the brightest minds in the world to work in the US.

How to handle the Cap for H-2B Visas

H-2B Visas are issued to temporary non-agricultural workers from foreign countries every year. The program enables employers having difficulty finding employees for positions available at their firms to fill them with workers from overseas that have the requisite skills for the job.

DACA and Central America Immigration

One of the reasons frequently cited for this influx of youngsters was the President’s decision in 2012 to institute the Deferred Action for Childhood Arrivals (DACA) program. Opponents of this program created by an executive action issued by the Department of Homeland Security claimed that this latest migration resulted from the decision to grant the DACA recipients temporary legal and work status.

Municpal IDs in NYC

The IDNYC program – as it is called - doesn't grant card holders residency status or access to federal or state benefits. Only the federal government can confer immigration status to people entering in or residing in the United States. But the new cards will enable residents to obtain driver’s licenses and set up bank accounts with some institutions.     And it will provide some popular benefits such as free access to city museums and grocery store discounts.

When returning to the country, they will need to present a valid, unexpired “green card” (Form I-551, Permanent Resident Card). When arriving at the port of entry, a U.S. Customs and Border Protection Officer will review their permanent resident card and any other identity documents they present, such as a passport, foreign national I.D. card or U.S. Driver’s License in order to determine if they can reenter.

In addition, the USCIS is expanding the population eligible for DACA program to people of any current age who entered the United States before the age of 16 and lived in the United States continuously since January 1, 2010.  The agency will not be accepting applications before that date and makes clear on its website to beware of those individuals who seek to take advantage of potential applicants by claiming they can aid in procuring DACA status for them prior to such date.

Across the country, judicial and executive officials are taking actions which – at least in some states – will shield some undocumented immigrants from potential detentions and arrests. In Illinois, the governor issued an executive order which prohibits the state police authorities from using immigration status as a sole reason to detain someone. In Arizona, a recurring battleground of immigration battles, a federal judge blocked the use by local law enforcement of the criminal offense of “identity theft” as a pretext for arresting such immigrants.
