Breach of confidence and unconscious copying

The design for the cauldron in the London Olympic Games ceremony was copied, say some. "Oh no it wasn't" retort the Games organisers. But there were earlier designs which had been disclosed. So could there have been unconscious copying? 

If the first designs sowed a seed in the minds of the organisers could then the idea have been passed unwittingly and obliquely to other designers for the next brief? If it germinates into the same embodiment does that lead to breach of confidence or copying?
