Breach of confidence and unconscious copying

The design for the cauldron in the London Olympic Games ceremony was copied, say some. "Oh no it wasn't" retort the Games organisers. But there were earlier designs which had been disclosed. So could there have been unconscious copying?

If the first designs sowed a seed in the minds of the organisers could then the idea have been passed unwittingly and obliquely to other designers for the next brief? If it germinates into the same embodiment does that lead to breach of confidence or copying?
The settlement between Atopia and Locog is one of the few legal wranglings over intellectual property to become public – and shows just how hard it is to prove an idea is one of a kind• Exclusive: row over Olympic cauldron design settled out of court

When does a search engine's auto-complete function constitute trade mark infringement?

Lush's battle against Amazon is the latest to consider the use of brands as keywords. In the spotlight this time are retailers own websites and the auto-complete function.
Just as a tree grows and blossoms with age, so too do principles of law.  That is clearly apparent from the latest High Court judgment in Cosmetic Warriors Ltd and Lush Ltd v Amazon.co.uk Ltd and A...
