First DUI Arrest

California law enforcement are working hard on catching drunk drivers behind the wheel of a vehicle.

DUI check points, increase in police vehicles during weekends and holidays, all are geared toward getting drunk drivers off the road.

It is not a good feeling to see flashing red and blue lights behind you when you know you have a few drinks with your friends not too long ago. All the bad thoughts start running through you head. You pull over, the officers walks up to your window, asks for license and registration, then asks “Have you been drinking tonight?” You are then asked to step out of the car, and required to perform a field sobriety test. Then you are asked to breath into a breathalyzer, and wait a few seconds while it calculates your blood alcohol level. You need the help of an experienced Sacramento DUI lawyer.

Charged with a DUI? Avoid Jail – Save Your License. Call us today!

Sacramento DUI laws are such that every DUI arrest gives rise to two different cases: a DUI court case, and a DMV Hearing. If you’ve been arrested for DUI in Sacramento, or any type of Sacramento drunk driving offense, you must contact the Sacramento DMV within 10 days of your DUI arrest, or you license will be automatically suspended. Even if you are from another state, and don’t have a California driver’s license, you must contact the DMV driver safety office if you’ve been arrested for DUI, otherwise the Sacramento DUI suspension imposed by the DMV will be reported to your home state, and your license suspended there

Why do we need criminal procedure?

Suppose that we had statutes that had proclaimed certain conduct to be criminal but no police, prosecutors, or courts to implement the statutes.

If criminals were not afraid of being caught and prosecuted, it would hardly deter them from committing crimes, and it would send a powerful message that, as a society, we were not serious about punishing wrongdoers.

Criminal Lawyer in Sacramento CASuppose, by contrast, that we were determined to crack down on crime. We would establish a criminal process that would go as far as possible in investigating crimes and punishing criminals. The police would wiretap everyone’s phone, stop and search everyone walking down the street who looked suspicious, come into any home of office without knocking, and beat confessions out of suspects. In court, the defendant would not be allowed a lawyer, only the prosecutor could present a case, and a judge could convict the defendant on flimsy evidence.

When can the police conduct a search & seizure?

The law of search and seizure governs some of the most basic police investigative techniques, including wiretapping and other electronic surveillance, examination of business records, and going through people’s trash.

In addition to more traditional techniques such as stopping suspected criminals and searching their clothes, cars, or other belongings.

Your Miranda Rights

After you are arrested, the police must advise you of your Miranda rights before they can question you. But in a mere “stop and frisk” situation, the police do not have to advise you of your Miranda rights before questioning. If you have been arrested for a crime in Sacramento county, contact a criminal lawyer Sacramento CA Richard Allaye Chan for free criminal defense case consultation today. If the police are conducting a routine investigation and asking a number of people what they know about the crime, each person need not be advised of his or her Miranda rights before questioning.
