The Supreme Court in the recent case of ParkingEye Ltd v Beavis has significantly departed from the previously well-established law relating to contractual penalty clauses. 

A penalty clause is a term of a contract which is intended to punish the party who breaches the contract by inflicting a liability well in excess of the actual losses which would be suffered.

Nando’s, the international casual dining restaurant group is opening on Harrogate’s Parliament Street as part of the town’s restaurant quarter which includes Jamie’s Italian and Bar & Grill. Nando’s already has a network of restaurants in Yorkshire but this will be the first in Harrogate. 

Nando’s is currently being fitted out in the 3,000 square foot property next to Jamie’s Italian and plans to open in early June. International restaurant business, Nando’s, instructed Raworths in the deal with total investment in the project worth a six figure sum.

Peter Atkinson, Acquisitions Manager for Nando’s says: “We are delighted to be finally opening in Harrogate and it is somewhat appropriate here that we should be using Harrogate property solicitors, Raworths who have acted for us on so many other property transactions elsewhere across the country.”

I frequently meet individuals following a death in the family who wish to contest a relative’s will.  They usually feel extremely aggrieved by the provision or lack of it which has been made in the will for them.

I also meet people who are put in a very difficult financial position as a result of a death.  For example, the deceased has not made sufficient provision for them even though they were dependent upon the deceased before death.

What can be done for these people ?
