Law Enforcement Officials have a very tough job. They are often called upon to make a split-second decision to save a life, sometimes their own. Police Officers put their lives on the line daily in Ohio. However, there are occasions when law enforcement goes overboard and exceeds their legally permissible use of reasonable force to subdue a person and use excessive force to intentionally cause severe pain, permanent personal injury or even wrongful death.

Don’t drink and drive. Have alternate plans to get home if you are out having a drink with friends. Get the Uber app or call a taxi. Unfortunately, many believe they are OK to drive after just one drink, but if pulled over and tested, the BAC could register enough for a DUI. If you are pulled over, you have rights. Know them:

The Fourth Amendment helps protect the privacy of every American citizen, regardless of age, gender, or race. Under it, police must have reasonable suspicion to search homes, make arrests, and take other actions. In many cases, they also require a warrant, handed out by a judge, before acting. Police can’t search anywhere that you have a “legitimate expectation of privacy.” This applies to your home, apartment, clothing, hotel room, vehicles, backpacks, etc. There must be a reason to be searched.

Drug trafficking is a serious offense in the state of Ohio. You may have to spend a significant amount of time in jail and pay a substantial fine if convicted. If you are found to offer, sell, or distribute drugs close to a school or kids, then the offense is treated even more harshly. Laws dealing with drug possession and trafficking can be frightening and confusing, especially in Ohio, thus the best thing you should do is contact a knowledgeable criminal defense attorney. 513.260.2099

Statistics show that the odds of being pulled over for drunk driver dramatically increase between Thanksgiving and New Year’s Eve. This is in large part due to the increase in alcohol consumption during the holiday season. Whether you are hosting a company party or a party for your friends and family, it should come as no surprise that police are doubling up this time of year. If you find you or a guest gets pulled over, even after a glass of wine or two, please remember to remain silent and polite. Don’t answer any questions and incriminate yourself. As a criminal defense attorney in the Cincinnati area, I can help immediately. 513-260-2099
