The first and most important step in receiving workers’ compensation is to notify your employer of your injury. They must file a report with the state and their workers’ compensation insurance company, who should in turn contact you within 48 hours. If you do not hear anything, you should contact a lawyer. By law, the company has to investigate the claim within 21 days. Your claim could face being delayed, or even denied. These 21 days are critical. Within them, you should contact a lawyer.

PA law requires all employers to carry workers’ compensation insurance to protect their employees. If you are injured on the job, you should be eligible for workers’ compensation coverage. Employers that evade this coverage in order to keep money in their pocket could be subject to criminal charges. Sometimes employers will try to steer workers away from seeking workers’ comp coverage. If this happens to you, you need a lawyer.

Your ability to provide for your family and yourself should not have to suffer because you are injured. If you were hurt on the job, workers’ compensation insurance is designed to pay you at a rate that is similar to what you were earning prior to your injury. This is known as the “average weekly wage” and is based on 2/3 of your weekly earnings prior to injury. To make sure that the insurance company is calculating your payments correctly and that you are getting the compensation you are entitled to under the law, contact a lawyer. We’re here to answer your questions.

We were pleased to welcome students from the Center for Independent Living- Transitional Skills Center to our office! They’re studying the judicial system, and we had the opportunity to discuss the law and seeking employment in a law office with a disability. We enjoyed meeting the students and helping them achieve their goals!

Many people rely on workers’ comp in order to pay their bills and sustain their lives after a work injury. But how much does it truly compensate? In order for proper compensation to be calculated, the pay is based on the average amount of money that the injured worker earned before their injury occurred. This is known as the “average weekly wage.” Questions? Consult a competent attorney who knows the law, and your right to compensation.
