Trial Wrap-up for the Week of August 26th. This week in Harris County, Dustan Neyland picked a jury on a case of driving while intoxicated under the influence of drugs. The client was fully cooperative with the police, was very sleepy, feeling ill, and was NOT intoxicated. The state ended up dismissing the case during trial. When a case is dismissed after a jury is picked and sworn, the case can never be tried again under the doctrine of "double jeopardy". In this case, we prevailed for the client and didn't even have to wait for a verdict.
