Today, I was able to get another case thrown out by a grand jury.  The client was charged with assault on a family member and was only charged because be had more injures than his wife who was the aggressor and because the wife called the police first.

I secured a No-bill from a Harris County grand jury today for a client charged with Sexual Assault of a Child. The client was falsely accused by the family of a teenage neighbor. There was no evidence to support the charge. False allegations of sexual assault can ruin someone's life, which is why it is important to hire an experienced sexual assault defense attorney immediately upon being accused. Often times, an attorney can investigate the case and work with the district attorney to present the defense side of a story to a grand jury prior to being charged. In this case, the client was already charged, but we were still able to clear their name.

Trial Wrap-up for the Week of August 19th - This week we went head to head with the State of Texas defending a young lady who was wrongfully accused of assault with a beer bottle.  The client wanted to prove that she was innocent of the charges and hired Dustan Neyland to try her case.  The client had originally been charged with a felony case of aggravated assault with a deadly weapon.  The previous attorney did no investigation on the case and ended up setting it for trial.  The client decided to fire the other attorney and hired Dustan.  After Dustan was hired and conducted a thorough investigation by attempting to obtain evidence and interviewing all the witnesses, the state dismissed the felony charge and re-filed it as a misdemeanor. 3 weeks later the case was tried to a jury and we received a verdict of "Not Guilty".  The client was wrongfully accused and justice prevailed! #wrongfullyaccused‪   #notguilty

Great trial results on a theft case in the Harris County criminal courts today. One of the main elements in a theft case in Texas is that the prosecution must allege and prove the value of the item. If the prosecution doesn't prove that the value of the alleged item that was stolen is within the statutory range of the offense alleged, then they will fail to meet their burden of proof and will not be able to convict the accused with the offense as charged.

If you are not in the "service industry" then you are likely not aware of the laws concerning liquor sales.  Liquor violation laws such as serving alcohol to a minor and serving alcohol to an intoxicated person are Class A misdemeanors punishible by up to a year in jail.  TABC (Texas Alcoholic Beverage Commission) also regulates the days and times that alcohol can be sold.  Liquor stores have always been closed on Sunday under what was known as the "blue laws".  Blue laws typically restricted the sale of certain items on sundays and most have been repealed.  This legislative session, Rep. Senfronia Thompson from Houston has sponsored a bill to repeal the restriction of liquor on sundays. If you support repealing the law restricting sales of liquor on sunday, then contact your representitive and ask them to support HB 421.

For the second time in less than a week we were able convince a Harris County Grand Jury located in Houston, TX to refuse to indict a client who was charged with deadly conduct.  The client shot at a burglar that was in the process of breaking into his car.  He missed the burglar and accidentally hit a car that was driving through the parking lot.  The client called 911 and the police came out, accused him of being a drug dealer, arrested him, charged him with a 3rd degree felony offense of Deadly Conduct by shooting at a motor vehicle that was occupied, and didn't even bother to investigate the burglary.  It's a sad day when you get charged for lawfully protecting your property. #notguilty   #nobill   #violentcrimeslawyerTX

We secured a No-Bill from a Harris County grand jury for a client charged with Possession of a Controlled Substance - PCP in the 174th District Court.  The client gave a ride to a person he thought was a friend who ended up stashing a bottle of PCP in the clients' car.  He was facing 2 - 20 years in prison if convicted, but instead, he will walk away a free man with no criminal record.  #Nobill   #notguilty    #pcp   #druglawyer

Trial Wrap-up for the Week of August 26th.  This week in Harris County, Dustan Neyland picked a jury on a case of driving while intoxicated under the influence of drugs.  The client was fully cooperative with the police, was very sleepy, feeling ill, and was NOT intoxicated.  The state ended up dismissing the case during trial.  When a case is dismissed after a jury is picked and sworn, the case can never be tried again under the doctrine of "double jeopardy".  In this case, we prevailed for the client and didn't even have to wait for a verdict.

Got a no-bill yesterday for a client charged with possession of methamphetamine and possession of cocaine . The driver threw drugs where my client was sitting when the cops pulled them over. The client was truly in the wrong place at the wrong time. Be careful who you associate with. ‪#‎wrongfullyaccused‬ ‪#‎notguilty

Just because a police officer pulls you over does not mean that you are breaking the law.  Last week, I won a motion to suppress on a marijuana case because the State failed to prove that the officer had a legal reason to stop the client on an alleged traffic violation.  Because the stop was deemed to be illegal, the marijuana seized as a result of the stop cannot be used as evidence against the client.  In the end, the case was dismissed and the client was able to avoid a drug conviction.

This was a successful week in obtaining great results for clients. On Wednesday, March 6th I was able to secure a “No-Bill” from a Harris County Grand Jury on an Injury to a Child case filed against a wrongfully accused father. Also, after a two-day trial I was able to earn a “Not Guilty” verdict for my client accused of assaulting her husband. The jury listed to the testimony and agreed that the client acted in self-defense.

My wife and I were involved in an auto accident in 2012. The at-fault driver ran a red light and T-boned my vehicle at 50 mph. The at-fault driver's insurance company had us in their office less than 48 hours post-accident trying to get us to take what seemed like a suspicious deal. I consulted Dustan Neyland and signed a contract for him to represent me to the insurance company. I could not be happier with the results. My wife and I did not attempt to game the system. We went back to work the next week, painful as it was. Due to this, the insurance company wanted to pay virtually nothing stating we were not really injured. Dustan negotiated a great deal for us (we had realistic expectations and were not trying to get rich). He is obviously in practice to make money, but that did not keep him from keeping his clients' best interest as a first priority. You will not go wrong hiring him for representation.

I think I had a great attorney. He was a former DA in Harris County, so he knows how they work and think. He knows the law and legal system very well. He was able to prove to the DA that the cops took my blood without a valid warrant and he was able to get my case dismissed. After this was all over, he was able to help me get my record cleared.

I WILL NEVER USE HIM AGAIN, I SHOULD OF LOOKED CLOSER AT LAWYERS BEFORE CHOOSEING ONE THAT GOT ME MORE THEN I SHOULD HAVE GOT!!!!!!! I WOULD NOT RECOMMEND HIM TO ANYONE UNLESS YOU WANT TO GET MORE STUFF THEN YOU SHOULD!!!!!
