I have seen countless cases where my client's version of the events of their arrest are completely different from the version given by the arresting officers. Unfortunately, if there is no video, this sort of thing never comes to light, especially since most cases resolve in plea bargain rather than hearings and trial. This sort of activity makes it harder for the officers that are actually doing their job properly to be trusted by the community. #testilying #nypd #searchandseizure #criminaljustice #nycriminaldefenders #innocent

It makes sense that 4/20 would be a day that there are more fatal accidents, similar to Superbowl Sunday. There needs to be a valid test to show impairment by marijuana, the same way there is one for alcohol. #marijuana #weed #420 #DWI

This could be great legal precedent, for defense attorneys to make legal arguments regarding the Constitutionality of bail being set if the defendant's ability to pay the bail isn't considered when making the bail determination. #bailreform #cjreform

This is a really good decision made by the San Francisco DA, to proactively wipe out all misdemeanor marijuana convictions, and reconsider felony marijuana convictions, in the wake of legalization of marijuana in California. Hopefully, this will really help those individuals that have had to deal with a criminal record related to marijuana. #marijuana #weed

Lowering the blood alcohol level for intoxication sounds reasonable, from the standpoint of preventing DWI related accidents and deaths. However, the majority of DWI related accidents involve drivers with a BAC higher than the current .08%. NY already has a statute to charge someone with a violation of driving under the influence of alcohol if their BAC is between .05 and .07, and that is not deterring people from committing DWIs in NY. This proposal to lower the BAC will result in more people that are not intoxicated, getting arrested and charged with crimes. Instead, the penalties should be stiffer for individuals that have been convicted of multiple DWIs, they are often the real problem. #dwi

Sadly, this man, like so many others is in a cycle of arrests that is not being broken by his voluminous time spent in Rikers Island. At an estimated cost of $750 per day to keep an inmate locked up there, NYC has spent hundreds of thousands, if not millions locking him up, instead of trying to figure out some way to help him. The system needs to be reformed to get individuals like him into something that will prevent future arrests, rather than what it is currently doing. #cjreform #rikersisland

NY is finally (and hopefully) on the path to ending cash bail for indigent people accused of crimes. I've seen people that have been forced to plea guilty to get out of jail because they didn't have money to bail out and fight their case. That should never be the case in a "fair" society where you are presumed innocent until proven guilty (which is not really the case). I hope this goes through, which will even some of the playing-field with people that can afford to bail out. #cjreform #innocent #criminaldefense #bailreform #nycriminaldefenders

There are still rogue NYPD police officers that are not documenting stops that they are making, which is against department policy. In an effort to change the old stop-and-frisk policy, officers are supposed to document all stops, so monitors can make sure that certain groups aren't being treated in an unfair manner. Police officers must stop thinking that they are above the law, in order to be able to have better relations with the public.

This new rule in NY, requiring prosecutors to disclose favorable information to the defense before trial, could be huge! Hopefully this helps to cut down wrongful convictions, and forces prosecutors to take a real look at their cases before going all the way to trial. Just lay all of the cards on the table, and the trial will sort it out. #criminaldefense #cjreform
