When a person passes away in British Columbia, their estate usually requires probate. Probate is the process that verifies the validity of a Will, or alternately what will happen with the deceased person’s assets if a Will was not in place prior to their death. Navigating The Wills, Estates and Succession Act (WESA), which governs the probate process, can be very confusing.

Having a well-documented estate plan ensures that your estate will be distributed according to your wishes. This may require the settlement of a trust. Our estate lawyers can help you establish various trusts, such as Testamentary Trusts, Family Trusts (as part of an estate freeze and corporate reorganization), Joint Partner Trusts and Alter-Ego Trusts.

In claims with serious injuries often expert witnesses will be consulted to assess and quantify things such as lost income, future income loss, lost pension benefits, future cost of medical treatments, etc. Your lawyer should both inform & help you retain competent individuals in those fields.
