We asked our wills and estates department: What happens in BC if you die without a will?

McQuarrie Hunter: “In BC, if you pass away without a will, we say you have died ‘intestate’. Your estate is then distributed according to the Wills, Estates, and Succession Act, s. 20-23 (WESA). WESA uses a ‘parentelic’ system, which means the descendants of the ‘nearest common ancestor’ have priority.

What does that mean? If you have a spouse and children, they get a preferential share. The amount your spouse receives depends on whether or not you had your children with that spouse or with someone else. If you do not have a spouse or children, then your estate will go to your parents. If they are deceased, then your siblings will receive it, and after that, it goes to their children.”

Are there minors or other people you would like to provide for that WESA doesn’t recognize? Talk to one of our wills and estates lawyers: http://www.mcquarrie.com/individual-services/107-wills-estates-and-personal-planning/

Our COO Catherine Jacobs had the privilege of attending the Greater Vancouver Board of Trade event yesterday in Vancouver where Premier Christy Clark announced the plans for the 2017 BC Budget.

Here were her key takeaways from the event for families and businesses:

For Families:

1. MSP premiums will be cut in half effective Jan. 1, 2018 for families with net income of up to $120,000. The government wants to eliminate MSP premiums altogether and not hide it in taxes.

2. BC has been #1 in Canada in job growth for two years, and now has the lowest unemployment rate in Canada (first time since 1976).

3. The BC government is committed to building jobs and recognizes a job is the most important life-changing thing in most people's lives.

4. The BC government recognizes that current housing prices have become too expensive and have introduced the HOME program with the goal of providing up to $37,500 in loans to assist homeowners with a down payment.

For Businesses:

1. The BC Government is working to eliminate the PST on electricity for businesses.

2. BC will be just behind Manitoba with the second lowest small business corporate tax rate of 2%, dropping it 5% from the current 2.5% for small businesses.

3. For the 12th year in a row, BC retains its Moody’s Investors Service AAA credit rating with one of the most competitive tax rates for residents and businesses in Canada.

Estate litigation lawyers can help families resolve potential disputes among family members following the death of a loved one. Conflict that arises around wills, property ownership, and caring for elderly or incapacitated family members is exceptionally difficult for everybody involved. Estate litigation lawyers can guide you as you deal with these issues. Even when there is no will, it is still best to deal with these issues as soon as possible after a family member passes away, as grief may sometimes cause conflicts to become more intense.

If you decide to move in with someone who has children, the law may require you to pay child support in the event that you separate. This could be the case if you helped support the children for at least one year. If your ex-partner applies for child support within one year of the last time you helped out financially, you could be required to provide that support. If your domestic situation is changing and you want to understand the financial implications, get the advice you need from our family law department.
