Why Hire a Family Law Mediator?
I am a Canadian Lawyer working in Toronto, Canada and I also work in Family Law.  I wanted to highlight this great article by +Hayes, Berry, White & Vanzant LLP as it covers many important issues for both Canadians and Americans and Family Law.

Thanks for the great article +Hayes, Berry, White & Vanzant LLP
Mediation and Family Law
Why Hire A Family Law Mediator?

Family ties are some of the strongest bonds known to humankind. They can shape us, influence our decisions and impact our identities on multiple levels. From time to time, as is expected, family members get into altercations with one another. Most of the time, families can work out their issues on their own after the dust settles, but sometimes, as is the case with divorce and child custody matters, they must seek professional help to resolve their issues. When instances like these occur, it is a wise idea to consider seeking the help of a family law mediator.

What Is Family Law Mediation?
Mediation is a form of alternative dispute resolution that allows disputants in a family law issue to come together and discuss mutually agreeable solutions to their problems in the presence of a third party – the family law mediator. In many cases, mediation is more cost effective and less time consuming than going to court to settle differences. A family law mediator enables family members to meet in a neutral setting to discuss their issues and come up with solutions that are favorable for everyone involved. Family law mediators are trained professionals who do not make any decisions pertaining to the issues at hand. Instead, they carefully listen, remain unbiased and facilitate creative strategies to help the mediation process move along in a positive light.

Family Law Mediation Tips
Family law issues are often complicated and emotionally charged. This being the case, it is important for the involved parties to show care and respect when working with a family law mediator.  Some other tips for a successful mediation outcome include:

1. Come to the mediation session(s) with different ideas about solutions.
2. Avoid hearsay and stick to the issues at hand with a mind to come to an agreement; no “he said/she said.”
3. Show up to the family law mediator’s office willing to talk things out, negotiate and be open to compromise.
4. Do not belittle the other party’s character or personality; stick to the facts and try to come up with solutions.

The nice thing about mediation is the fact that the family law mediator does not make any decisions. Instead, the disputants settle on their own solution, which is then put in writing and filed with the Court. If you have exhausted all other means of settling a family dispute and are thinking about going to court, consider contacting a family law mediator from Hayes, Berry, White & Vanzant first.
