One principle influencing the Founders was the principle involving the extent of individual liberties. Keen defenders of individual liberty, they also recognized, as do we, that the individual must be subservient to others when the rights of one endanger or crush the rights of others. Hence, for practical and philosophical reasons, we agree not to drive in any direction on all sides of highways and byways. We thus corral our actions to preserve the peace and safety. Not taking peanuts to a place where children may be negatively affected is simply a rule that respects life itself. In the absence of clear understandings or rules, we have the judiciary. Courts exist to arbitrate the collision of individual versus individual and individual versus a collective when rights and opportunities are in question or danger. To suggest that lawsuits are somehow to blame for clashes arising from human nature is to betray the principles of civility and justice. Furthermore, the likelihood of a lawsuit resulting in sizable financial returns is less than 5%. Most lawsuits filed never proceed. Of those that do, parties are more likely to settle than engage a judge or jury, and of the ones that proceed to be heard before a judge or jury, the "hot coffee" reward is almost as rare as being struck by lightning. Finally, the "hot coffee" reward had merit when all facts are well known. The company had received numerous complaints of harm because of the temperature of the coffee, and the woman did indeed suffer serious burns. She initially asked only that her medical costs be offset, but the company refused.

A 14-year-old male orangutan found with air gun metal pellets embedded in his body, is looked over by a vet in Indonesia.
