Know your Miranda Rights - Many individuals taken into police custody or stopped while driving presume that their incriminating statement cannot be used at trial because they did not receive a Miranda warning prior to making their disclosure.  However, this represents a fundamental misunderstanding of the Miranda warning.  Law enforcement agencies are not required to give an individual a Miranda advisement of rights during every encounter.  There are a number of situations where statements of a defendant can be used even though he or she never received a Miranda warning prior to providing the incriminating information.  Because a person cannot be sure whether his or her statements fall within the protection of Miranda, the best policy is to never speak to the police before or after receiving a Miranda warning.
