What is an Impartial Medical Exam for Workers’ Compensation Claims?

In Massachusetts, when a worker is injured on the job, as part of their workers’ compensation claim, an injured worker may be required to attend an impartial medical exam. An impartial medical exam is different than an independent medical exam, which is an examination arranged by the workers’ compensation insurance company. The impartial medical exam is an examination required at a certain stage of a workers’ compensation claim by the Massachusetts Workers’ Compensation Act. When required, the examination is arranged and scheduled by the Department of Industrial Accidents (the “DIA”).

It’s December and weeks away from Christmas. This is the time of year that many businesses have their holiday parties where co-workers get together for food and drinks and celebrate the holiday season. Some businesses have their holiday parties at their place of employment and others have them at a local restaurant or establishment.

Another Thanksgiving has come and gone. The end of Thanksgiving kicks off the Christmas and holiday shopping season. This means that there will be an increase in traffic and pedestrians on our Massachusetts roadways and highways. The increase in traffic creates an increased risk of accidents and injuries. I Collected Workers’ Comp Benefits, Returned to Work, But Had to Go Back Out Due to the Same Injury. Will I Continue to Receive Benefits?

In many Massachusetts workers’ compensation cases an injured worker may be out of work due to his or her injury, collected workers’ compensation benefits, but returned to work at some point only to go back out due to the same injury. What happens then?

Bad Car Accident with Serious Injuries in Marlborough, MA

On a summer day, our client was driving on a divided highway in Marlborough, Massachusetts. While driving over the crest of a small incline, she noticed a commercial vehicle backing up the wrong way on the roadway. It was too late and she was unable to stop. She collided with this commercial vehicle and suffered severe injuries, including a right lateral tibial plateau fracture.
