BAC Tests in Florida (https://goo.gl/EGMCaj)

If a law enforcement officer has probable cause a person was driving under the influence then makes an arrest, he or she can then conduct a BAC (Blood Alcohol Content) test to find out how much alcohol is in the blood.

The types of tests include:
Breath test - While breath tests offer immediate results, they're not always accurate. They work by determining the amount of alcohol that passes through the breath to estimate the blood alcohol content. "The devices used in Florida are known as the Intoxilyzer 8000 series."

Urine test - These tests can be done at the time of arrest and are then sent to laboratories. Because of the possibility of error, they're done when other methods aren't available.

Blood test - Blood tests are more accurate than the other two, but there can still be mixups in the lab that affect the results.

Determining if Drivers are Impaired (https://goo.gl/LKwMRM)

For those arrested for a DUI, it can be tough to figure out what to do next. Because of this, it's crucial to hire an experienced DUI lawyer for help.

"With the legal knowledge and negotiation skills possessed by a qualified attorney, you could potentially have your case dismissed, or at least reach a more favorable outcome than if you attempted to defend yourself."

How officers determine impairment - Police officers first use observations, and they might look for bloodshot eyes, pale skin, slurred speech, or trouble walking.

If there's reasonable suspicion a driver is impaired, an officer may then conduct Field Sobriety Tests.

They may also do a BAC (Blood Alcohol Content) test to see if your BAC is above .08.

Your Orlando Personal Injury Lawyers (https://goo.gl/ck8V4j)

If you've been hurt due to the negligence of another, you deserve to have an experienced injury lawyer on your side to prove the negligence and help you recover damages.

4 main elements of proving negligence:
>< Duty of Care - The defendant must have had a duty of care toward the plaintiff. For example, another reasonable person in this situation would have been able to realize that certain actions could lead to injury.

>< Breach of Duty - The defendant didn't carry out his/her duty of care. For example, if someone is driving with a broken headlight and hits another person, his/her duty of care was to make sure the vehicle is well-maintained and safe to drive.

>< Cause - "The defendant's breach of duty must be the reason why the plaintiff suffered injuries and is suing."

>< Damages - The plaintiff has to prove he/she was hurt because of the defendant's acts.

We handle a variety of personal injury cases including medical malpractice, construction site accidents, slip and falls, boating accidents, auto accidents, defective product liability, wrongful death, and more.

Defenses Against Drug Charges (https://goo.gl/E6B8qe)

There are multiple possible defenses your lawyer could use against drug charges. Examples include:

Lack of Reasonable Suspicion or Probable Cause - Under the Fourth Amendments to the U.S. Constitution, police officers are prohibited from conducting unreasonable searches and seizures.

To be pulled over, an officer has to have reasonable suspicion you committed a crime or probable cause you committed a traffic violation. They must then have probable cause to perform a search without a warrant or to arrest someone. (They could also do so with your consent.)

If these requirements aren't met, the evidence they find has to be thrown out of court.

Lack of Consent - "Without a warrant or probable cause, law enforcement cannot perform searches and seizures unless they have your consent." However, is an officer acts in a way that makes someone think they're not allowed to say no to a search, the consent wasn't truly given, and the evidence has to be thrown out.

Lack of Possession - A prosecutor has to prove you had control over the substance and knew of its existence.

No Valid Driver's License (NVDL) Charges in FL (https://goo.gl/N7Vn4o)

Along with Driving While License Suspended (DWLS), this is a common offense, but the consequences are typically misunderstood.

NVDL is when someone is driving without a valid driver's license. Also, the license doesn't necessarily have to be issued from the state where you get the citation. Many don't realize NVDL is a criminal offense and can cause a permanent criminal record.

DWLS is often more serious, as licenses are often suspended after failing to pay traffic fines, not paying child support, reckless driving, DUI, etc.

If you've been charged with NVDL or DWLS, you might consider hiring an experienced attorney for help. At Leppard Law, our expert criminal defense attorneys will consider the unique factors of your case to create the best defense.

Possible DUI Charges One May Face in Florida (https://goo.gl/RFMkfd)

Examples of DUI charges include:
>< Second DUI - There are stricter penalties for those who get a second DUI within five years of the first.

>< DUI Manslaughter - If another person dies as a result of a person driving under the influence, the person could be charged with DUI Manslaughter. "This is a second-degree felony, punishable by up to 15 years in prison and a $10,000 fine." There's also a 4-year minimum prison sentence.

>< DUI with Property Damage or Injury of Another Person - If another's property is damaged, or another person is hurt while someone is driving under the influence, it's considered a misdemeanor.

>< Aggravated DUI - This applies to serious incidents such as if a person has a very high BAC, if a child is in the vehicle, if there's a severe injury or death, or if the person doesn't have a valid driver's license.
