What is a licensed conveyancer?

Licensed conveyancers are able to undertake a wide range of legal work relating to property and business. They may act as legal advisors in the sale, purchase, mortgage or lease of residential and commercial property and small business, within the guidelines set down in the current Conveyancers Licensing Act.

The New South Wales Office of Fair Trading issues licenses to practise as a conveyancer after the Office is satisfied that an applicant has an approved educational qualification and relevant practical experience and training with a licensed Conveyancer or a legal practitioner.

Conveyancing is the legal process where ownership of real estate, house or land, is transferred from one person to another. The person making the sale is the vendor and the purchaser is the buyer.

This involves the preparation of legal documents – including a contract of sale and transfer of land document which are signed by both parties – property searches carried out on the property and attending settlement of the matter.

The parties or participants to a conveyancing transaction are:

Vendor – the seller
Purchaser – the buyer
Financial institution (the bank) – where they have provided finance in exchange for a mortgage over the property
Solicitor or Licensed conveyancer managing the transaction on behalf of the
vendor and purchaser respectively

New VOI regime in Victoria

A new VOI regime started in Victoria on 9 November 2015. This regime aligns all conveyancing transactions in Victoria with the VOI requirements for e-settlements. This means that all lawyers, conveyancers and financial institutions must take reasonable steps to verify the identity of their clients and customers.
