In a recent case the courts looked into discrimination arising out of disability and specifically into whether the employer must be aware that the act of its employee, which led to unfavourable treatment, was linked to the employee’s disability. The Employment Tribunal answered in the negative: for the discrimination claim to stand, this employer’s knowledge of the link to disability is not required. On appeal, the Employment Appeal Tribunal and the Court of Appeal both agreed.

When a vehicle is subject to a hire purchase agreement, you as a trader are entering into an agreement with the finance company. The consumer is then entering into the hire purchase agreement with the finance company.

The agreement between you and the finance company will be subject to an extensive contract, the finance company's terms and conditions. We often need to review these agreements as finance companies quite often attempt to rely on the clauses.

While we have already set out the new parameters for MOT testing, it is worth repeating that not only have the categories for potential failure and Advisory items been amended and widened, being placed in three new definitions, but that such changes should be regarded as sound guidance for ANY work you undertake on a car at any time.

New venue for this years #CDX18 meant a journey north to Manchester. Normally our departure from the Lawgistics Tower of Power is preceeded by hours of back breaking work loading our legal library, books, bookcases, chairs and all into the back of a van. But oh the joy our new display stand, beautiful, lightweight and easy to assemble. In previous years we would have collapsed exhausted into the van and spent the journey trying to catch our breath. But now, loaded in an instant, we could enjoy our journey north. Upon arrival at Manchester Central our earlier joy in packing the van was dwarfed by the sheer unadulterated bliss we felt when the stand took minutes….minutes to unload and assemble.

Social media is playing an increasingly large part in our working lives from the recruitment stage to dismissal and both employers and employees need to consider the extent to which they wish to involve it and monitor it in order to maintain standards of professionalism whilst accepting it as part of modern life.

Finally the noise around GDPR has quietened down and most of us can get back to business safe in the knowledge that we are GDPR compliant. However, we have already seen our first complaint and request for compensation from a customer who has complained that someone saw their personal data on a screen in a dealership. No doubt other speculative letters and claims for compensation will follow.

Having presented workshops at previous CDX events, this year our Nona Bowkis will be tackling one of the hottest topics around, not just for the motor trade, but business in general, GDPR (General Data Protection Regulations). Preparedness, what you should have done or should be doing to be ready for May 25th.
