Do you have questions about your divorce or child custody case? Read this story below and check out our free divorce guide. The answer might be more simple than you think!

Child Support or Custody: Which is the Right Choice -

If you're a father going through a divorce, you essentially have two choices when it comes to the care of your children.  You can seek primary custody or you can allow custody to belong to your spouse while paying child support.  Sure, there are plenty of other details that are involved in a divorce but when it comes to couples with children; it usually boils down to one of those two choices.

Christopher Bridges, the Atlanta rapper who goes by the alias 'Ludacris', is currently involved in a child custody/child support dispute. Instead of opting to pay more in child support he has taken matters into his own hands. Ludacris is now seeking primary custody of his two year old daughter.  If he wins he could end up receiving support from his child's mother.

According to an article written in the International Business Times (http://au.ibtimes.com/articles/540608/20140226/fastfurious7castupdatenewselease.htm) Mr Bridges allegedly lost a lot of income because of the delay of Fast and Furious 7.  He has filed papers declaring himself a fit and capable parent and cited his active relationship with his preteen daughter as evidence.

What does this mean for other couples dealing with similar issues? Mediation may have prevented this situation entirely. Mediation should always be your first option. You should always meet with a mediator before going to court.

If you want to know all of your options we are here to help.  Please take a look at our free divorce guide (http://www.knclawfirm.com/GeorgiaDivorceGuide.pdf) and contact us if you have any questions.

PRACTICE AREAS

Contested Divorces - Contested divorces are filed when couples aren’t able to come to an agreement in regards to dividing assets, sharing child custody, deciding upon alimony and so forth. If you do plan on filing for a contested divorce, you should consult with one of our skilled divorce attorneys in Georgia.

Child Custody - Georgia law states that under joint legal custody, both parents have the right to contribute to major decisions regarding their children, and both parents share equal responsibility in carrying out those decisions. Joint physical custody, on the other hand, refers to the amount of time that a child is permitted to spend with each parent.

Contact us to talk about the type of child custody that suits your needs.

Child Support - Generally speaking, in Georgia the non-custodial parent in a divorce is often required to pay child support to the custodial parent for the child’s living expenses. How much is paid depends on the Geogria "income shares" model. Talk with us and we'll help you understand Georgia laws concerning child support

Alimony Payments - Alimony in Georgia is generally awarded according to the needs of a spouse and their ability to earn income on their own. Alimony payments, under Georgia family law, may be temporary or permanent.

Uncontested Divorces - The definition of an uncontested divorce is that both a husband and wife agree on all issues (or are willing to try to negotiate in good faith) including child custody, child support, alimony, the division of assets, and more.

Domestic Partnerships - Some of the options our domestic partnership attorneys can assist you with are the creation  of mutual powers of attorney, reciprocal wills, living wills, child custody and visitation rights agreements, and the actual  domestic partnership agreement (similar in many ways to a pre-nuptial agreement).

Contact us and we'll help you understand the importance of having will and agreements.

Prenuptial Agreements - Georgia prenup can help protect any assets you may own at the time you are married. If children are involved, a prenuptial agreement may protect your children in the event of a divorce or the death of a parent by ensuring that your children receive all assets that are due to them.

Prenuptial agreements have become a necessity that protects you, your assets, and your loved ones.

Adoptions - Adoption is one of the beautiful things to do and we at Kitchens New Cleghorn are thrilled to assist clients in the adoption process. We happily work with traditional as well as non-traditional families, single parents, and gay or lesbian couples.
