A lot of employees are taking cover in the security blanket of Amendment 64, which legalized marijuana in Colorado. However, this same rule is what allows employers to terminate an employee when the latter uses marijuana...

We received this testimonial from one of our Worker's Compensation clients, who happens to be an insurance adjuster.

We are touched by his kind words and what he had to say about having Mike on his side as his attorney, and also wanted to share with you a work injury claim from the perspective of an insurance adjuster at a worker's compensation insurance company. You may be surprised at how difficult it was for this client to get his claim processed, even knowing the inner-workings of an insurance company.

Today, Michael Kaplan, one of our Denver Workers Compensation Attorneys, on behalf of the Workers’ Compensation Education Association (The leading advocate group for Colorado injured workers), testified before the Division of Workers Compensation regarding its proposed changes in WCRP Rule 8. In coordination with C.R.S. 8-43-404, Rule 8 governs, in part, how employers and insurance carriers designate medical providers that are authorized to treat an injured worker.

The Colorado Workers’ Compensation Act gives employers and insurance carriers the “right, in the first instance”, to designate providers of their choosing. Unfortunately, the majority of the providers who are designated don't provide quality care and are biased in favor of the insurance industry. Kaplan Morrell prioritizes getting its clients as much quality care in a system that doesn't provide a lot of quality care; as such, Michael Kaplan volunteered to testify today.

The latest on the Northern Colorado workers comp blog: A Greeley worker lost his life after a Greeley plant with a history of work injuries and accidents, did not follow #OSHA #worksafety guidelines.

Too soon to tell, but we hope this helps inspire them to make some serious changes in their work safety practices.
