Evil gets a new name: 'Modern-day Neros'

NEW DELHI: In an unprecedented judgment dealing with communal violence in Gujarat and its aftermath, the Supreme Court has warned people about "modern-day Neros".

A Bench of Justices Doraiswamy Raju and Arijit Pasayat has ordered a fresh trial by a Maharashtra court, giving liberty to Gujarat DGP to reinvestigate the charges, so that victims don't feel that justice was denied to them.

In a connecting judgment on human rights activist Teesta Setalvad's appeal, seeking expunging of certain unwarranted remarks made by the Gujarat High Court against her, key witness in the Best Bakery case Zahira Sheikh, and the National Human Rights Commission headed by former Chief Justice of India A S Anand, the Bench had the occasion to remind the judges, particularly those who passed the strictures, of judicial restraint and the rule of law.

But, why did the judges think of Nero? The judgment does not offer an answer to that. Nero was a Roman emperor and was condemned to death by the Roman senate in 68 AD. Historians say he was considered an "evil man", who was responsible for the death of many Christians. An "inept tyrant", Nero was believed to be leading a "self-seeking life".

The judgment does not name any administrator. But it says: "The modern day 'Neros' were looking elsewhere when Best Bakery and innocent children and helpless women were burning, and were probably deliberating how the perpetrators of the crime can be saved or protected."

The judges further said: "Law and justice become flies in the hands of these 'wanton boys'. When fences start to swallow the crops, no scope will be left for the survival of law and order or truth and justice. Public order as well as public interest become martyrs and monuments."

Those responsible for protecting life and properties and ensuring that investigation was fair and proper seem to have shown no real anxiety. "A large number of people lost their lives. Whether the accused persons were really assailants or not could have been established by a fair and impartial investigation," the court said.

Such acquittals were "unmerited, based on tainted evidence, tailored investigation, unprincipled prosecutor and perfunctory trial and evidence; and threatened or terrorised witnesses".

In the apex court's view, "it is no acquittal in the eye of law; and no sanctity or credibility can be attached to the so-called findings" of the trial court and the Gujarat High Court.
