Walking the halls at the capital in Sacramento meeting with Senators and Assembly Members to educate them on current legislation that will have a positive impact on injured workers in California. The California Applicants' Attorney Assoc. (CAAA) is working hard to make a positive changes for injured workers.

Lobby Day 2015 - Today, fellow CAAA members and I are meeting with California Assembly Members and Senators in Sacramento to discuss current issues in Workers Compensation. We will be discussing current Senate and Assembly Bills aimed at removing gender bias and other injustices for injured workers from the Workers' Compensation system in California.

Work injury rates among women ages 55 to 64 are 50% higher than men of the same age. CA Workers Compensation laws must address the needs of the Female workforce...more so as the working Female ages.

The comparison of Independent Medical Review (IMR) appeals of decisions upholding Utilization Review (UR) denials of doctors' recommended medical care in workers' compensation compared to group health is staggering. Some might say the denial rate of medical care in workers' compensation claims is criminal. The struggle to receive adequate medical care plagues every injured worker in California. Denials of medical care for the small pool of workers' compensation patients as opposed to the large pool of group health patients is shocking to say the least. I often receive the following question from prospective clients: "do I really need a workers compensation attorney?"

My simple answer is if you are asking this question or you have suffered a work injury you will not know if you need a skilled workers compensation attorney until you speak with one and have your case evaluated. Keep in mind that the California workers compensation system is based on a set of continuously changing laws, the California Labor Code.

If you have suffered a work injury you want to ensure that you are receiving all of the benefits that you are entitled to under the current law. A workers compensation attorney can help evaluate your specific situation to ensure that you are receiving the appropriate benefits in your workers compensation case.

Unfortunately most work injuries have additional factors associated with them that increase the complexity of the case. For example, a third party might have caused the injury to occur giving rise to a potential claim against that third party. Other events occur that make a case complex are the employer firing or discriminating against the injured worker because of the occurrence of the work injury. There are many other situations that can make a workers compensation case complex where the injured worker might be entitled to more benefits and/or greater settlement awards.

I recommend contacting a skilled workers compensation attorney to have your case evaluated. Following the case evaluation you will have a better understanding of the level of complexity in your case and whether or not you need to hire a skilled workers compensation attorney.
