The police didn't read me my rights?  Does that mean my case will be dismissed or thrown out?

How many times have you heard that?  Here's a link to my latest blog post with audio podcast on that topic

Thought I'd try something new.  Audio podcast regarding shoplifting and civil demand letters in California (Penal Code 490.5)

Do you have to pay the "fine" the store is demanding if you were accused of shoplifting or theft?

Prop 47 may have made possession of drugs a misdemeanor in California, but people are still being charged with felony possession.  How?  PC 4573 - bringing drugs into a jail.

Interesting point, +Joe Dane. Proving "intent" is sometimes overlooked by prosecutors and can be beneficial to our clients.

Joe Dane - Orange County Criminal Defense Attorney
Introduction
A brief introduction.  My name is Joe Dane and I was a prosecutor with the Orange County District Attorney's office and have been practicing law for over 17 years now.  I have handled every type of criminal case - from DUI, petty theft, domestic violence up to felony cases such as gang charges, homicide (murder and manslaughter). Before law school, I was a Reserve Deputy Sheriff in Los Angeles County, working uniformed patrol.  I attended the LA County Sheriff's Academy with awards for academics and firearms and earned the "Top Cadet" honor.  While a patrol deputy, I would typically work 100 hours a month - all for a dollar a year.
