Thought I'd try something new.  Audio podcast regarding shoplifting and civil demand letters in California (Penal Code 490.5)

Do you have to pay the "fine" the store is demanding if you were accused of shoplifting or theft?

I hear ya. It depends - the underlying charge, the nature of the violation, what steps the defendant has to correct the issue between allegation and hearing... Is it set in stone? No, but . . .

Introduction
A brief introduction.  My name is Joe Dane and I was a prosecutor with the Orange County District Attorney's office and have been practicing law for over 17 years now.  I have handled every type of criminal case - from DUI, petty theft, domestic violence up to felony cases such as gang charges, homicide (murder and manslaughter). Before law school, I was a Reserve Deputy Sheriff in Los Angeles County, working uniformed patrol.  I attended the LA County Sheriff's Academy with awards for academics and firearms and earned the "Top Cadet" honor.  While a patrol deputy, I would typically work 100 hours a month - all for a dollar a year.
