For the second time in two months, the Consumer Financial Protection Bureau took out an enforcement action in the buy-here, pay-here industry. On Thursday, the enforcement came against Herbies Auto Sales, an operator in Greeley, Colo., for what the bureau deemed to be abusive financing schemes, hiding auto finance charges and misleading consumers. It looks like the FTC is beginning to focus on spot deliveries. It's concerning that they apparently feel that rewriting contracts at more expensive terms is potentially a "Scam". Dealership personnel would be wise to shore up their spot delivery procedures moving forward. Besides violating state regulations and potentially having to hold the contract in-house, the spectre of a federal UDAP violation may well be the next big thing in the FTC's trick bag.

The Federal Trade Commission recently rolled out a new resource catering to Hispanics in an effort to curtail what the regulator believes are potential pitfalls in the vehicle purchasing and financing process.

Introduction
Jim Radogna is an automotive compliance specialist and the Director of Compliance at the College of Automotive Management and it's parent company, The Lloyd Andersen Group of Companies, Inc. (LAGC). Before joining LAGC, Jim founded Dealer Compliance Consultants, Inc., a national automotive compliance resources and training firm. He developed a strong background in dealership operations, having spent over 15 years in dealership management. His experience includes working in diversified roles including sales manager, F&I director, general manager, and training director. In addition, he served as compliance officer for a large auto group, where he developed and integrated a comprehensive compliance program. Being well-versed in all aspects of dealership operations, Jim has used his knowledge and industry experience to develop unique, no-nonsense compliance and reputation management solutions for automobile dealerships of all sizes. These programs are designed to not only protect dealerships from liability, but also greatly enhance the company’s reputation, increase profitability through consistent processes, and increase customer satisfaction and retention.

Jim is a sought-after speaker and frequent contributor to several automotive industry publications including Dealer Magazine, Automotive News, WardsAuto, Auto Dealer Monthly, DrivingSales Dealership Innovation Guide, AutoSuccess, CBT News Magazine, and F&I Magazine. I recently completed the online training from the College of Automotive Management and all I can say is WOW! I've been in the car business for over 20 years as a salesman, finance manager, sales manager, even GM so I thought I knew just about everything there was to know about the biz. I decided to take the courses at the college because I've always heard good things about their program and I believe you should never stop learning. Well, they far exceeded my expectations and I'm utterly amazed at how much I learned about doing business the right way and maximizing my income. Maybe you can teach an old dog new tricks? If you're in the car business, or thinking about getting into it, I highly recommend you check out the college. They can show you how to be the best-of-the-best and make a ton of money! I wish I did this 20 years ago, maybe I'd be retired now ;-)
