How can a person get four "first" offenses of DUI in Pennsylvania? In the past, a person did not have a "prior offense" unless he or she had been convicted of the charge before being charged with the new offense. Pennsylvania law recently changed to close what many perceived as a loophole in the DUI sentencing law. Had this incident happened today, the man would be sentenced as a 1st, 2nd, 3rd, and 4th time offender, and his sentence would have been much different. How different? Read the article to find out.

With the Senate passing it already, it does at least appear to have some momentum.  It has made it further this year when compared to last year, when I don't think that it was even voted out of the committee.  Hopefully it is passed and signed by the governor.  I still don't think that the law goes far enough, but it is a start.   #expungement

Interesting post from #newjerseydivorcelawyer  +Edward Weinstein of +Law Offices of Edward R. Weinstein that discusses a recent child custody case in which the courts reiterated their stance against sole custody unless sole custody is clearly in the best interests of the child.  There is a preference to having both parents involved as such an arrangements tend to be in the best interests of the child.  Great post.

Interesting idea.  As a criminal defense lawyer, I admit that I am not completely in favor of expanding civil forfeiture laws as they tend to be abused, but I can also understand that a primary way to punish a street racer is to take his/her pride and joy, the car.  Thanks for posting #losangelesdefenseattorney  +Steven Sweat of +Glotzer & Sweat, LLP.

Thanks for sharing this important story +Jason Dunkle It is very sad. We do not really known the motivations of the girl. I hope parents and educators will take time and discuss this with children/students. If a friend or someone you know is talking about suicide, ALWAYS take it seriously and let someone know.

Even if your child does not have these apps on their phone or tablet, you do not know what apps their friends are using. Talk to your children about technology and being safe.
Many parents may be surprised about the photos and videos a child may be sharing with friends. They may also be seen by strangers.

Wow.  I understand that a person has a right to his own beliefs, but I am not sure whether or not a racist cop should be a police officer.  In a recent trial in the City of Brotherly Love, #philadelphiadefenselawyer  +R. Patrick Link of +LinkLaw, LLC cross-examined a cop in a Possession With Intent to Deliver case racist propaganda that had been found in the officer's work locker to challenge the credibility of the officer.  The client was lucky that his defense attorney researched the officer's background, reviewed his personnel file, and uncovered this damning information.

Designated Drivers Often Fail to Remain Sober

A new study released by the Journal of Studies on Alcohol and Drugs indicated that more than 40% of alleged designated drivers do not abstain from drinking, they simply drink less than they normally would. Also, almost 20% of alleged designated drivers will exceed the legal Blood Alcohol Level, which is currently 0.08%, when they get in the car.

A survey of many drivers across the United States voiced the opinion that it’s okay for designated drivers to drink, so long as their BAC doesn’t exceed the legal limit. However, this just isn’t true. Multiple studies have shown that cognitive ability, perception, and physical response type starts to significantly lag at around 0.05%, which is well below the current legal limit in the United States. Mild impairment begins as low as 0.02%!

Introduction
Jason Dunkle is a State College criminal defense lawyer that started his own firm, JD Law, P.C., in 2012.  I have been practicing criminal defense in Central Pennsylvania, primarily in Blair, Centre, Clinton, Clearfield, Huntingdon, and Mifflin counties since 2004.  I have represented people charged with a variety of criminal offenses, including DUI, drug delivery and drug possession, simple assault or aggravated assault, furnishing alcohol to a minor, underage drinking, theft, rape, firearms related offenses, and violations of the wiretapping act.  

My office is located in downtown State College, so within minutes of the University Park campus of Penn State University.  I am a Penn State alum for my Bachelor's Degree, but I attended the University of Pittsburgh School of Law for my Juris Doctor degree as they offered me the academic based Dean's Scholarship.  In 2011 and again in 2012, I was nominated as a "Rising Star" by Super Lawyers.  I am a member of the Pennsylvania Association of Criminal Defense Lawyers and was a guest lecturer at a continuing legal education course on Drug Suppression Issues in Pennsylvania.
