WILL YOUR FITBIT DATA HELP MAKE YOUR CASE?

PERSONAL INJURY LAWYER HELPING THE INJURED IN WEST PALM BEACH BY USING FITBIT DATA

Fitness tracking devices have become ubiquitous in today’s society. Whether you are at the office, out shopping in West Palm Beach, or out on the sand, you are bound to find several people their counting steps or logging miles with an activity band or watch around their wrist.

While these devices can serve as motivators to keep you on your feet throughout the day, they could potentially serve another important purpose as well: If you get injured in an accident, they could provide key evidence to support your claim for compensation.

ACTIVITY TRACKING DATA AS EVIDENCE IN PERSONAL INJURY CLAIMS

Whether you wear a Fitbit, Garmin, Apple Watch, or any other brand of fitness band or smartwatch, the device on your wrist records an extraordinary amount of information about your daily activities and routine. Depending on which device you use and how you use it, you could be creating and storing comprehensive data about your exercise habits, sleeping habits, overall fitness, heart rate, day-to-day movements, and general level of activity. When seeking financial compensation for an injury, these types of data could potentially help in the following ways:

Your GPS data could be used to prove that you were at the location of the accident when you claim that it occurred. This could be important, for example, if a business is claiming that you did not get injured on its premises.
Your exercise and activity data could demonstrate that you are unable to enjoy hobbies such as bicycling or running as a result of the injuries you sustained in the accident. Or, this data could show that you are simply taking less steps overall due to your medical condition.

Information about your sleeping habits could show that you have been persistently losing sleep as a result of the accident.
The aggregate data from your fitness tracker or smartwatch could be used to show that your overall fitness has declined in the weeks and months following your accident or collision.
Your GPS and activity data could also help demonstrate that you have been following your doctor’s advice. It is common for defense attorneys and insurance companies to claim that accident victims are not doing enough to help their own recoveries, and your fitness tracker could potentially be used to prove otherwise.

Of course, there are certain limitations and potential drawbacks to relying on activity data in a personal injury case as well. For one, some device makers – including Fitbit – have faced lawsuits alleging that their data are unreliable. It could also be the case that your fitness data would do more harm than good (for example, if you have been exercising or going to work instead of resting per your doctor’s orders). But, under the right circumstances and with the help of a savvy personal injury team, the device on your wrist could turn out to be the key to success in your personal injury claim.

WHAT IS A CATASTROPHIC INJURY?

EXPERIENCED ACCIDENT ATTORNEY SERVING VICTIMS OF CATASTROPHIC INJURIES THROUGHOUT WEST PALM BEACH

On many personal injury lawyers’ websites (including ours), you will see several references to the term “catastrophic injury.” Over the years, we have come to learn that, while people are generally familiar with the terms “catastrophic” and “injury” when used separately, they are confused about what exactly they mean when they are put together. When is an injury considered catastrophic? Is my injury catastrophic enough to seek a financial recovery? These are common questions, and you are not alone if you are unsure of your rights after being involved in a traumatic accident.

DEFINING THE TERM “CATASTROPHIC INJURY”

In general terms, a catastrophic injury is any injury that has the potential to result in serious long-term or permanent effects. Cuts, bruises, and minor sprains – injuries that can heal within a week or so without medical intervention – would not be considered catastrophic. However, if a severe laceration requires stitches and leaves a permanent scar, or if a sprain is bad enough to require surgery (usually referred to as a “tear”), then it may fall into the category of a catastrophic injury.

While there is no precise definition of what constitutes a catastrophic injury, the following types of injuries are all generally considered catastrophic:

Broken bones
Facial injuries resulting in scarring or disfigurement
Lacerations requiring many sutures or stitches
Organ damage and other internal injuries requiring surgery
Spinal cord injuries
Sprains, strains, and tears that require surgery
Traumatic brain injuries (including concussions)
Other disabling injuries and injuries requiring surgical repair

HAVE YOU BEEN DIAGNOSED WITH A CATASTROPHIC INJURY?

If you have been injured in an accident, you do not need to be concerned with trying to categorize your injuries. All you need to know is this: If you were injured and someone else was to blame, under Florida law you may be entitled to financial compensation. You should seek a medical diagnosis right away (if you have not done so already), you should carefully follow your doctor’s advice, and you should speak with an attorney who can help you understand the full extent of your injury-related losses.

5 ESSENTIAL BACK-TO-SCHOOL SAFETY TIPS FOR PARENTS

It’s hard to believe that we are talking about back-to-school time already, but the first day of classes for students in the School District of Palm Beach County is August 14, 2017. While the start of the school year brings excitement for some and trepidation for others, it is a time when everyone should be making safety a top priority.

Whether you shuttle your kids to school, your kids take the bus, or you have teens who are driving themselves (or riding with friends), here are five safety tips to keep in mind for the 2017-2018 school year.

1. TEACH YOUR CHILDREN ABOUT SCHOOL BUS SAFETY

If your children ride a school bus, there are several steps you can teach them to help avoid the risk of dangerous accidents on the road. For example, while waiting at the bus stop, children should be sure to stay well out of traffic, and they should remain attentive to their surroundings at all times. They should also wait until the bus has come to a complete stop before approaching the door. You can learn lots of additional information about school bus safety from the National Safety Council (NSC).

2. PUT THE PHONES AWAY

This goes for both teens and adults. Driving is not a time to be scrolling through social media feeds or texting with friends. Data from the National Highway Traffic Safety Administration (NHTSA) show that teens are more likely to talk or text while driving than adults, but not by much. Set a good example for your teen drivers by putting your phone out of reach while driving, and consider implementing a family policy of never picking up a phone while behind the wheel.

3. WARN YOUR TEENS ABOUT THE RISKS OF DRIVING DISTRACTIONS

Along with cell phone use, there are countless other distractions that lead to car accidents throughout Florida on a daily basis. Your teens are new to driving, so they may not fully understand the level of impairment that can result from being distracted. Help your kids understand the effects of driving distractions, and impress upon them the importance of letting their friends and bus drivers stay focused on the road.

4. KEEP A SAFE DISTANCE

Even if you and your children avoid distractions, unfortunately, other people won’t. Keeping a safe distance from the car in front of you can give you the opportunity to stop or maneuver around a potential collision. Avoid tailgating; and, if someone is tailgating you, let them pass when it is safe to do so.

5. OBEY THE SPEED LIMIT

It is no secret that many teen drivers get a rush from driving fast. Likewise, parents may feel the need to speed in order to drop their children off and still get to work on time. But, the morning drive to school is not a time to take risks with your life and the lives of others around you. On a short drive to school, speeding doesn’t really save much time at all (and it doesn’t save any time if you cause an accident), and you can likely find a way to leave earlier if you are repeatedly running behind schedule.
