When you buy a home, you “take title” to the property—meaning you become the rightful owner. This ensures that no one else can claim full or partial ownership of the #home in the future. This is important not only to you, but also to your lender—which is why it’ll require that a #titlecompany conduct a search of public records for any long-lost heirs insisting the property is theirs, liens (from contractors who worked on the home but were never paid), or other problems.

If all goes well, your title will be cleared and the lender will process the loan. But just in case it doesn’t, the lender will require that you buy #titleinsurance , a policy that will pay for the expense of researching any claims and court costs that could crop up in the future.

Additionally, your title company will offer you owner’s title insurance, which isn’t typically required but often recommended, because lender’s #insurance won’t protect you personally. To cut costs, look into whether you are eligible for a “reissue” rate on the policy currently in effect, which would offer a substantial discount.

HCI Group Inc., with a subsidiary that’s the largest property and casualty insurer in #Florida , has named Mark Harmsworth senior vice president of finance.

Harmsworth brings more than three decades of finance experience to HCI. Most recently, the certified public accountant was president of JMH Consultancy Group, where he was chief strategy officer advising Stewart Information Services, a #realestateservices firm based in New York.

Previously, he was chief financial officer at First American #TitleInsurance Co., senior executive vice president at First Canadian Title Insurance Co. and executive vice president of Re/Max Ontario-Atlantic Canada Inc., an affiliate of the American residential real estate brokerage chain.

If you are purchasing a house and putting a mortgage on the #property, your mortgage lender will require that fire insurance is in place. Even if you are not placing a mortgage in connection with your purchase, you should ensure that you have obtained fire and liability insurance.

If you are purchasing a standard condominium, the condominium corporation is required to maintain #insurance to enable the corporation to repair the building in the event of a fire loss.

Note that the condominium corporation’s insurance only covers restoring the “standard condominium unit”. You need to make sure that you buy your own insurance in order to cover replacement costs of any improvements or upgrades you have made to your unit. You also need to insure your contents and to obtain liability insurance with respect to the unit.

In March, the U.S. Treasury Department began requiring #titleinsurers to identify and file information on the owners of limited liability companies — LLCs — that pay more than $1 million cash for property in Miami and more than $3 million in Manhattan.

The purpose, one Treasury official said, is to see whether "corrupt foreign officials or transnational criminals may be using premium U.S. #realestate to secretly invest millions in dirty money."

LLCs protect their owners from #personalliability and also help shield their names. They are perfectly legal, and many cash buyers in the #Tampa Bay area use them. But that type of sale is not very common at the priciest end of the bay area's residential market, a Tampa Bay Times analysis found.

There will be no "free houses'' for Floridians who have defaulted on their mortgages but continue to live in their homes without paying.

In a major opinion, the Florida Supreme Court has ruled that lenders can resume foreclosing at any time, even if they have taken no action in years. Previously, they had to act within five years of when the borrower first defaulted.

While a boon for banks, the ruling is a blow to thousands of delinquent borrowers who hoped that their cases would be permanently dismissed and that the banks could no longer collect on the outstanding mortgage debt.

You did it — you bought a home!

Not only did you put an offer on the table, you made it to the closing table! The documents have been signed, the keys have been handed over and you’ve officially got a new address. Now what?

At closing, the #title company gives buyers copies of all the documents they signed. They can be hard copies, on a disc or via a link to an encrypted website. Regardless of how you receive them, make sure you know how to access the information when you need it. Title companies do keep copies; however, it may take a little time to access them when needed.
