A lost or expired green card can lead to other problems to do with driver’s licenses, employment and foreign travel. This is because you may be unable to prove your legal status. A person with a lost or expired green card should immediately file an I-90 to obtain a replacement green card.

An I-551 Permanent Resident Passport stamp or Adit stamp as temporary evidence of permanent resident may however be obtained in some cases. Usually the I-90 receipt notice for the replacement green card and a valid foreign passport are required.

One smart solution to the lost green card problem however is to become a US citizen at the earliest opportunity. A naturalized US citizen with a lost or stolen US passport can usually replace her passport in a few days. A permanent resident may have to wait over 6 months to replace her green card.

"The United States must do a better job of attracting and keeping the world’s best and brightest. As such, our immigration proposal will award a green card to immigrants who have received a PhD or Master’s degree in science, technology, engineering, or math from an American university. It makes no sense to educate the world’s future innovators and entrepreneurs only to ultimately force them to leave our country at the moment they are most able to contribute to our economy."

Successful I-130 re-filed after withdrawal and immigration waiver after deportation of Japanese national.

A client who suffers from a psychological condition for which she has been treated for several years withdrew her immigration petition for her husband a citizen of Japan at the adjustment of status interview. There were no incidents of domestic violence in the case.

The withdrawal of the petition caused the husband to be detained in mandatory detention for one month and removed top Japan under strict rules to do with Visa Waiver entrants. It was during this detention that the client contacted me.

We re-filed the petition supported by robust evidence including multiple doctors’ reports to prove that that the diagnosed psychological condition predated the incident. We also filed a waiver to cure the husband’s inadmissibility after deportation so that he could return to his wife and children. His immigrant visa to return to the United States was approved.

The immigration code can be very complex and confusing. There are not always quick and easy answers to immigration questions and no case is a slam dunk.

One simple fact that does not appear important to most people can radically change a legal case. The best immigration lawyers are often those who appreciate the complexity of the law and do not offer guarantees, other than earnest hard work.

But if you expect a lawyer to give attention to your case you should be prepared to pay for it.

International Humanist and Ethical Union (IHEU) has released the first ever world report concerning discrimination against atheists and non-religious people http://tinyurl.com/apbbkqm

A persons can qualify for asylum in the United States if he is persecuted on account of his religious beliefs. But what if the person is persecuted because he has no religious beliefs?

One thing to avoid doing throughout the K1 visa process.

Sometimes a K1 visa applicant may become impatient to get married before the K1 visa is received and he or she travels to the United States. Do not do this.

U.S. immigration law requires that both parties must remain legally free to be married until the K1 visa applicant gets his or her fiance visa and travel to the United States.

Getting married will cancel the fiance visa petition and void the K1 visa. The petitioner will then have to refile a new immigration petition for his or her spouse from the beginning.

Did you know?

Divorce does not terminate the financial obligation of a US sponsor under Form I-864 Affidavit of Support.

A foreign national may surrender his right to sue his US citizen spouse under the I-864 as in an action for dissolution of marriage. But such surrender does not terminate the rights of government agencies or private entities to file suit against the US citizen for reimbursement of certain means-tested benefits given to the sponsored immigrant spouse.

Before you sign immigration paperwork with legal consequences, consult a lawyer.

Deportation of undocumented persons by ICE in FY 2012 smashed all records - 409,849 persons removed.

55 percent, or 225,390 of the people removed, were convicted of felonies or misdemeanors. Deportation record achieved through the use of Secured Communities, a controversial program under which local law enforcement check the immigration status of anyone who is arrested.

These are challenging times for anyone dealing with immigration. With the help of Gary the transition felt smooth. He helped my wife and I get organized and fill out all of the appropriate paper work needed, and there was a lot of it. He is reasonably priced and is genuinely a good person. He helped us substantially and he was with us every step of the way, including routine updates via emails and text message, and during the interview itself. I could not have been happier with the outcome and I recommend him highly. With the help at Goodin Law P.A. my wife is now a permanent resident and I am one happy and proud husband who can be secure that his wife is safe.

I have used Gary's service twice. once for the citizenship and another for the green card for the wife. It was a completely a different experience from my previous attorney where every time I needed a question answered, I had to deal with his rude assistants. with Gary, he handled every details of my application himself. Always returned my phone calls immediately. he is not only knowledgeable but also very personal and friendly. Being impressed may be an underrated description. He really goes the extra mile to make sure the process gets done the way it needs to be done. He is a very humble professional who knows how to treat people right. It seems that unfortunately, a lot of people mistreat the immigrants but Gary was nothing but absolute pleasure to work with. I believe it is because of the connection he makes with his clients from being a former immigrant himself who went through the same process as we all did. if you want an attorney that you can rely on who does his very best to help you, Gary Goodin is the answer. I wish I had him the first time I needed an attorney too.

My husband and I were extremely pleased with the service that Gary Goodin provided. We went to him for help with my husbands permanent residence. Gary was very thorough, he made sure we had every document needed and every little detail covered. We met with Gary several times before submitting the application and each time he was very friendly and personable. Once we filed the application he kept us updated with the status and when we went for our final interview he attended with us. Thanks to Gary my husband has his green card now. His fees were very reasonable and his service was above and beyond! I would definitely recommend Gary to anyone needing immigration help.

Gary Goodin is a wonderful immigration lawyer. He is an expert in his field, empathetic, gives thorough and clear explanations, and he never talked down to us. We had a bad experience with a previous lawyer who charged 3 times Gary's fees and then he only filed for my husband to have a work card, which needs annual renewal. For a fraction of the cost, Gary filed for my husband to have permanent resident status, which won't expire for 10 years. We recommend him to anyone with immigration needs, and we will definitely be calling him in 3 years to help my husband file for citizenship.

It is my pleasure to have worked with Gary Goodin as my immigration lawyer. He is meticulous about the details and items of your case but that is to ensure that there are no mistakes or issues. He is also very kind, friendly, and can relate to people of all backgrounds. I would not recommend any one else but Gary Goodin as your immigration lawyer. He will meet all expectations and go the extra mile.
