A lost or expired green card can lead to other problems to do with driver’s licenses, employment and foreign travel. This is because you may be unable to prove your legal status. A person with a lost or expired green card should immediately file an I-90 to obtain a replacement green card.

An I-551 Permanent Resident Passport stamp or Adit stamp as temporary evidence of permanent resident may however be obtained in some cases. Usually the I-90 receipt notice for the replacement green card and a valid foreign passport are required.

One smart solution to the lost green card problem however is to become a US citizen at the earliest opportunity. A naturalized US citizen with a lost or stolen US passport can usually replace her passport in a few days. A permanent resident may have to wait over 6 months to replace her green card.

One thing to avoid doing throughout the K1 visa process.

Sometimes a K1 visa applicant may become impatient to get married before the K1 visa is received and he or she travels to the United States. Do not do this.

U.S. immigration law requires that both parties must remain legally free to be married until the K1 visa applicant gets his or her fiance visa and travel to the United States.

Getting married will cancel the fiance visa petition and void the K1 visa. The petitioner will then have to refile a new immigration petition for his or her spouse from the beginning.

Successful I-130 re-filed after withdrawal and immigration waiver after deportation of Japanese national.

A client who suffers from a psychological condition for which she has been treated for several years withdrew her immigration petition for her husband a citizen of Japan at the adjustment of status interview. There were no incidents of domestic violence in the case.

The withdrawal of the petition caused the husband to be detained in mandatory detention for one month and removed top Japan under strict rules to do with Visa Waiver entrants. It was during this detention that the client contacted me.

We re-filed the petition supported by robust evidence including multiple doctors’ reports to prove that that the diagnosed psychological condition predated the incident. We also filed a waiver to cure the husband’s inadmissibility after deportation so that he could return to his wife and children. His immigrant visa to return to the United States was approved.

The immigration code can be very complex and confusing. There are not always quick and easy answers to immigration questions and no case is a slam dunk. 

One simple fact that does not appear important to most people can radically change a legal case. The best immigration lawyers are often those who appreciate the complexity of the law and do not offer guarantees, other than earnest hard work.

But if you expect a lawyer to give attention to your case you should be prepared to pay for it.

Divorce does not terminate the financial obligation of a US sponsor under Form I-864 Affidavit of Support.

A foreign national may surrender his right to sue his US citizen spouse under the I-864 as in an action for dissolution of marriage. But such surrender does not terminate the rights of government agencies or private entities to file suit against the US citizen for reimbursement of certain means-tested benefits given to the sponsored immigrant spouse.

Before you sign immigration paperwork with legal consequences, consult a lawyer.
