In the Torrance Superior Court, there was a general understanding that the judge handling Hermosa Beach cases would never agree to judicial diversion for any case, although this program was widely embraced throughout Los Angeles County and judges across the county granted judicial diversion liberally. This was true in Torrance with this particular judge (she is now resting in peace, having passed away in August, 2018), but in the following public urination case out of Hermosa Beach, pictured below, involving a female client, judicial diversion was granted. In the following case, our client in Santa Monica not only urinated in public, he unwittingly did so on the wall of the Santa Monica police station. Our client, age 21 and here in the U.S. on a student visa, was highly worried that he might serve time in a U.S. jail. After all, once stopped by a Santa Monica police officer, he was hauled to the police station, booked and forced to wait in jail for about three hours before being released. Our client was ticketed for public urination in Downey toward the newly developed area just a few blocks from Downey High School. She had enjoyed several drinks. After she left the bar and felt the cold air, she realized she needed to go back into the bar to use the restroom. However, it was about 1:45 a.m. and the bar refused to let her enter. She decided then to urinate along the edge of a parking lot. A Downey police officer saw everything take place and politely gave our embarrassed client a ticket for a misdemeanor. Public urination tickets in Fullerton are not $25 tickets, like a parking ticket. Instead, they are misdemeanor cases that can result in informal or summary probation, as well as fairly significant court fines. However, there are provisions in the California Penal Code that allow a creative attorney to resolve certain types of cases without a conviction scarring the client. When a person having a professional license issued by the state, i.e. as a doctor, lawyer, real estate broker, dentist, insurance broker, etc., comes to us facing a misdemeanor, there is a sense of anxiety about losing one’s job, or at least facing suspension of the ability to practice law, practice dentistry, etc. In the following public urination case out of Hermosa Beach, our client was a school teacher with a teaching credential. Birthdays are supposed to be special and memorable – with good memories. Just the opposite took place with our 23-year-old female client on her birthday. Her friends took her out for drinks and dancing in Hermosa Beach and as she was waiting for a taxi, she realized she needed to use the restroom. No bar would let her in, so she squatted between two parked cars and urinated in the location photographed below. Unfortunately, a Hermosa Beach Police Officer saw this taking place and ticketed her for public urination. However, the case was ultimately dismissed with no conviction. How did this take place? In Fullerton, Florentine’s Grill is centrally located where all the nightlife happens. It exits out to a small parking lot and is within walking distance of the large parking lot near the train station. Therefore, there are a lot of people in the area and, when the bars close for the night, a lot of people thinking about urinating. Some are able to leave the location and make it home; some are not. In the following public urination case arising out of our client urinating in a front yard in Santa Monica, in a residential area, our client was eighteen years old and about to leave for a four-year college out of state. He received the ticket for a misdemeanor and did a small amount of research online, enough to realize he could face six months in county jail if convicted. This caused him and his parents great anxiety, as his college plans might have to be put on hold. The parents and the client contacted Greg Hill & Associates. Greg Hill then resolved the case with no conviction of any sort, not even for an infraction.
